This Chapter 97 shall be known as the "Fires, Control of."
A.Â
The intent of this chapter is to prescribe minimum requirements
necessary to establish a reasonable level of life safety and property protection
from the hazards created by fires on private properties.
B.Â
This chapter is designed to supplement and expand upon
the requirements of the New York State Uniform Fire Prevention and Building
Code. Should there be a discrepancy between this chapter and the NYS Uniform
Code, the more restrictive provision shall apply.
As used in this chapter, the following terms shall have the meanings
indicated:
Includes the kindling or maintaining of any bonfire and the burning
of grass or trash/rubbish. The burning of materials shall be limited to paper,
cardboard, wood, leaves and garden refuse which are not wet, damp or tightly
compacted.
Fires on private property are restricted to the extent that:
A.Â
Such fires are located within a protected firepit, place
or equivalent ovens surrounded by fireproof enclosure materials;
B.Â
Such areas do not exceed three feet in width or depth
and such fires do not exceed three feet in height;
C.Â
Such fires are located not less than 30 feet from any
structure;
D.Â
Such fires shall be kept under the personal supervision,
at the location of the fire, of a responsible person at least 21 years of
age; and
E.Â
Such fires shall not burn before sunrise, or extend after
12:00 midnight.
Traditional cooking fires on private property are permitted, provided
that they are conducted in suitable barbecue pits, grills, stoves or burners,
and provided that they are continually monitored and conducted in a safe manner.
Any person found guilty of violating this chapter shall be guilty of
a violation punishable by a fine not to exceed $250 or imprisonment for not
more than 15 days, or both.
