No person shall hereafter set out or plant any tree known as a "poplar
tree" and "cottonwood tree" on or along any street within the Village of Phoenix
or in any place where it will or does affect, injure or endanger in any way
any sewer, drain, water main, catch basin, gutter or sidewalk.
All trees known as the "poplar tree" and "cottonwood tree" now or hereafter
standing and growing in the Village of Phoenix in any place where the same
does, may or shall be liable to affect, injure or endanger in any way any
sewer, drain, water main, catch basin, gutter or sidewalk are to be deemed
a public nuisance and a menace to sewers, drains, water mains, catch basins,
gutters and sidewalks, and all persons owning or in control of any such tree
shall cut down and remove such tree.
A.
Any person, firm or corporation violating any of the
provisions of this chapter shall be liable to a penalty of not to exceed $250
or imprisonment for not more than 15 days, or both.
B.
Any person violating this chapter shall be liable to
the penalty herein prescribed, to be prosecuted for and collected in the manner
prescribed by law with costs of proceedings.
