It shall be unlawful for any individual, association, partnership, firm or corporation to own, harbor and/or keep in custody any dog which disturbs the peace by barking, howling and/or making other loud noises to the annoyance and discomfort of any person in the Borough of Lehighton.
Continuous barking, howling or the making of other loud noise by any dog, for more than any one hour or continuous barking for periods of less than one hour, but more than 1/2 hour, which period occurs on two or more consecutive days, shall be deemed to be a disturbance of the peace and a cause of annoyance and discomfort to persons in the Borough of Lehighton.
Any person may request the Lehighton Police Department to warn any person who shall own, harbor or keep in custody any dog which disturbs the peace by barking, howling or making other loud noises to the annoyance and discomfort of persons in the Borough of Lehighton. A warning by the police shall be in writing and shall name, identify and specify the residence of the owner, keeper or custodian of the dog and shall identify and specify the name and residence of the person making the request and/or complaint. Upon receipt of such request and/or complaint, the police shall also give a copy of this article to the person identified as the owner, keeper or custodian of the dog.
A violation of § 85-5 of this article shall be deemed to have occurred upon a subsequent violation of this article after the date of delivery of the request and/or warning.

No person owning, harboring, keeping or in charge of any dog shall cause, suffer or allow such dog to soil, defecate or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property. The restriction in this section shall not apply to that portion of the street lying between the curblines, which shall be used to curb such dog under the following conditions:
A. 
The person who so curbs such dog shall immediately remove, in a sanitary method, all feces deposited by such dog.
B. 
The feces removed from the aforementioned designated area shall be disposed of in a sanitary manner by the person owning, harboring, keeping or in charge of any dog curbed in accordance with the provisions of this chapter.

Any person who violates or fails to comply with the provisions of this article shall be guilty of a summary offense and, upon conviction, shall be fined a sum not exceeding $600. Each day that such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
In the event that the Lehighton Police Department, as the result of this article or of any other Lehighton Borough ordinance or Pennsylvania statute, is required to pick up and transport and/or detain any dog, the owner and/or person in charge of said dog shall be assessed a fee of $20 and, in addition thereto, shall pay costs of $10 a day for expenses incurred in feeding and maintaining said animal.

No dog, whether licensed or unlicensed, muzzled or not muzzled, shall be allowed to run at large in any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property. It shall be unlawful and an infraction hereunder for any owner of a dog hereinabove defined to permit a dog, whether licensed or unlicensed, to be at large within the Borough, unless effectively restrained in the immediate custody and control of the owner or custodian of the dog by a chain or leash not exceeding eight feet in length affixed to the collar or harness of the dog.
