No person shall begin to construct, reconstruct,
alter, repair or grade any sidewalk, curb, curb cut or driveway within
the right-of-way line of any public street within the borough without
first obtaining a permit from the Building Inspector as provided by
this article.
An applicant for a permit shall file with the
Building Inspector an application showing:
A. Name and address of the owner, or agent in charge,
of the property abutting the proposed work area.
B. Name and address of the party doing the work.
C. Location of the work area.
D. Attach plans showing details of the proposed alteration.
E. Estimated cost of the alteration.
F. Such other information as the Building Inspector or
Borough Engineer shall find reasonably necessary to the determination
of whether or not a permit shall be issued.
The applicant shall file with the Building Inspector
in escrow a sum sufficient to defray the estimated cost of inspection
by the Inspector and Engineer of the work to be done.
The Inspector shall issue a permit hereunder
when he finds:
A. That the plans for the proposed operation have been
approved by the Borough Engineer to whom they shall be forwarded by
the Inspector within a reasonable time after receipt thereof.
B. That the work shall be done according to any standard
specifications of the borough then existing for public work of like
character.
C. That the operation will not unreasonably interfere
with storm drainage, vehicular and pedestrian traffic, the demand
and necessity for parking space, and the means of egress to and from
the property affected and adjacent properties.
D. That the health, welfare and safety of the public
will not be unreasonably impaired.
Where the use, convenience and necessity of
the public require, the Borough Council, through the Building Inspector,
shall have the authority to order the owners or agents in charge of
property adjacent to which curb cuts are now or in the future maintained,
to alter the curb cut in such manner as they shall find reasonably
necessary under the circumstances. The notice required by this section
shall:
A. Require compliance by permittee within 30 days of
the notice.
C. Be served upon permittee.
No person shall do or permit anything to be
done which shall constitute an obstruction to the free flowage of
storm- and surface waters in and along any gutter in the borough.
Any person maintaining a parking area or other
area adjacent to a public sidewalk in such a manner that such area
is not clearly marked by different paving material, planting, lawn
or other fashion as separate from the sidewalk shall, by painted line
or other means clearly demark and define a dividing line between the
sidewalk area and the adjacent area described above.
No person shall place or permit the placement
of any object on, or make any use of, the public sidewalks of the
borough which shall interfere with the free use of such sidewalks
for pedestrian travel along the full width of the sidewalk.
