[Adopted by Ord. No. 1975-4 as Sec. 3-4 of the Revised General Ordinances]
As used in this article, the following terms shall have the meanings indicated:
BUSINESS DAY
Any day not a Sunday or a national holiday.
BUSINESS HOURS
The hours between 8:00 a.m. and 6:00 p.m. on any business day.
ROADWAY
That portion of a street or highway improved, designed or ordinarily used for vehicular travel exclusive of the berm or shoulder.
SIDEWALK
That portion of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians.
STREET or HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
Every person in charge of or having control over any building or lot of land within the borough fronting or abutting on a paved sidewalk, whether as owner, tenant, occupant, lessee or otherwise, shall remove and clear away, or cause to be removed and cleared away, snow and ice from so much of the sidewalk as is in front of or abuts on the building or lot of land.
Snow and ice shall be removed from sidewalks in all commercial districts within the borough within 12 hours after the cessation of any fall of snow, sleet or freezing rain or by the beginning of business hours of the next business day following the fall, whichever period is shorter.
In the event that snow and ice on a sidewalk has become so hard that it cannot be removed without like likelihood of damage to the sidewalk, the person charged with its removal shall, within the time provided above, cause enough sand or other abrasive to be put on the sidewalk to make travel thereon reasonably safe; and shall then as soon thereafter as weather permits, cause the sidewalk to be thoroughly cleaned.
No person shall deposit any snow or ice on or against any fire hydrant or on any sidewalk or roadway, except that snow and ice may be windrowed on public roadways or curbs incident to the cleaning thereof.
Upon the failure of any owner to provide for the removal of snow in accordance with § 186-40 et seq. of this article the borough may cause the removal of the ice and snow and cause the costs thereof to be charged against the owner of the lands and premises which shall be added to and become part of the taxes next to be assessed and levied upon the property, and to bear interest of the same rate as taxes to be collected and enforced by the same officers and in the same manner as taxes. The owner of the property shall be notified within 10 days after the borough has caused the removal of ice and snow of the amount due based upon the hours expended in the removal of the ice and snow which notice may be effectuated by personal service or by certified mail, return receipt requested. In the event that the amount remains unpaid for 10 or more days after the notice as provided herein, the amount due shall be certified to the tax collector to be collected as aforesaid.
