It shall be unlawful for any person, firm or corporation to conduct a carnival, fair, circus or other exhibition or special event in the Borough of Old Forge without first having made application for and received a permit from the Borough Secretary, acting on behalf of the Borough Council, in accordance with the conditions and limitations as set out in this chapter.
A. 
The applicant for such permit shall file an application, in writing, with the Borough Secretary, which application shall be accompanied by the following information and assurances in a detailed plan:
(1) 
The type of exhibition.
(2) 
The number of admission tickets to be sold, if any, or approximate capacity of any and all buildings to be used.
(3) 
The amount of space and plan of the area where the exhibition would take place.
(4) 
The number of entrances to be opened for admittance to a building, if any, and, if applicable, the number of entrances to be used solely for admission to the exhibition seating area or areas.
(5) 
The number of staff, including security personnel.
(6) 
The parking facilities available.
(7) 
There are adequate sanitary facilities for the people expected.
(8) 
There are trash and litter receptacles for outside performances and exhibitions.
(9) 
The length of time the exhibition shall take place.
(10) 
The hours of the day or night during which the exhibition shall take place, subject to the restrictions of § 126-3 of this chapter.
(11) 
Such other relevant information as the Borough Secretary shall require.
B. 
The applicant shall furnish evidence that a public liability insurance policy shall be in force and effect at the time the exhibition takes place. No permit shall be issued until the Borough Secretary is satisfied that the owner, operator and/or sponsor of such exhibition has purchased suitable insurance to provide protection against foreseeable risks with respect to the operation of such exhibition.
C. 
The applicant shall furnish evidence regarding the safety of equipment to be used at the exhibition, if any. No permit shall be issued until the Borough Secretary is satisfied that the evidence of safety is sufficient with respect to the operation of equipment at the exhibition.
D. 
The application and plans as required shall be submitted to the Borough Secretary at least 10 days prior to the date of the event.
E. 
The Borough Secretary or his designee shall notify the Police Department and Fire Department of the receipt of plans as required under Subsections A through D and shall forward copies of these plans to the Police Department and Fire Department for approval.
F. 
The Borough Secretary shall have the authority to order additional staffing or any additional authority as needed to ensure the safety of the patrons and the public.
G. 
Nothing in this section shall be construed to relieve, in any fashion whatsoever, the liability of those responsible for the management and operations of the event, including the employment of adequate personnel for security, safety, health and sanitation.
H. 
If the Borough Secretary finds that all of the limitations and requirements of the permit and this chapter have been complied with or will be complied with by the applicant, he or she shall issue the permit conditional upon such reasonable limitations and requirements as he or she may deem necessary for the safety of persons and property.
A. 
Hours of operation. All carnivals, fairs, circuses, exhibitions and special events shall operate between the following hours only:
(1) 
Monday through Friday: 10:00 a.m. to 11:00 p.m.
(2) 
Saturday: 10:00 a.m. to 12:00 midnight.
(3) 
Sunday: 1:00 p.m. to 12:00 midnight.
B. 
The owner, operator and/or sponsor of such carnival, fair, circus, exhibition or special event shall not permit unnecessarily loud noises to issue from the premises on which such carnival, fair, circus, exhibition or special event is located, as prohibited by law.
Any person violating any of the provisions of this chapter shall be guilty of a summary offense and, upon conviction thereof in a summary proceeding, shall be sentenced to pay the costs of prosecution and a fine of not more than $1,000 and, in default of the payment thereof, shall be imprisoned for a period not exceeding 30 days.
