As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough Council or its duly authorized agent.
On and after August 1, 1917, all water furnished by said Borough, except for fire protection and other Borough purposes, shall be metered and charged for according to rates hereinafter fixed.

A. 
All now using water and desiring to continue after August 1, 1917, shall, not later than July 1, 1917, and all desiring water at any later date shall, make written application therefor. To cover cost of water meter, stop drain and installation thereof, applicant shall deposit with said Borough $30. All meters shall be furnished and set by the Borough at a suitable place selected by it, at the cost of the applicant. Charges for labor and material, including meter, are to be at cost to the Borough.
B. 
Every structure that receives water from the Baden Borough water system must have a remote reading device attached to the structure in a location easily accessible to Borough personnel. The Borough will furnish and install the device at a location it deems most suitable. The owner or resident will be responsible for the cost of the device and the installation thereof. If this device is not installed, the Borough will attach a $5 quarterly surcharge to the owner's or the resident's water bill.

All connections with water mains are to be made by the Borough, for which a tapping fee will be charged in accordance with Ordinance No. 55. This includes the street box. All service pipes from street box to meter and from meter to fixtures are to be furnished and installed by applicant. All to be done by or under the direction of the Borough.
A. 
Each consumer shall have a separate service pipe, except that double houses or rows of houses if supplied from one service pipe must have a separate shut-off box and meter for each consumer.
B. 
In addition, all existing apartment buildings or multi-unit structures whose water account becomes delinquent due to failure to tender timely payment and which are served from one service pipe shall be required to install a separate shut-off box and meter for each apartment or dwelling unit. In the event the owner of said delinquent account apartment building or multi-unit structure shall fail or refuse to install a separate shut-off box and meter for each apartment or dwelling unit, then in that event the Borough or its designee is authorized to perform said installation and assess the cost of said installation against the premises and against the owner of said building or structure.

C. 
Any newly constructed or renovated apartment building that supplies multiple apartments from one service pipe must have a separate shut-off box and meter for each apartment ("apartment" is defined in § 193-3).

Meters shall be kept in repair by the Borough at the expense of the owner. When requested by the owner or consumer, or when in the judgment of the Borough repairs or replacing are necessary, such repairs or replacing shall be done by the Borough and the cost thereof charged to the owner or consumer. If such costs be not promptly paid, the water will be shut off.
All meters shall be open to inspection and reading at all reasonable hours.
All applicants not owners of real estate in the Borough shall deposit with the application the sum of $5 or a larger sum if required, which sum is to be held as security for all bills rendered under this article. Such deposit shall be deposited by the Borough in a bank and any interest earned paid over to the depositor. When water service is discontinued and all bills paid, the sum is to be returned on return of the rest given therefor.
All consumers must notify the Borough on vacating any premises on which he is or has been using water and, until such notification, he will be liable for all water consumed thereon, which shall be charged against him or against the premises, which sum and the costs of turning off and on must be paid before the water will again be turned on.
On and after August 1, 1917, the water rate under the schedules hereinafter set forth shall fall due on the first days of October, January, April and July for the preceding period. A discount of 10% will be allowed for payment on or before the 10th day of the month following the period in which the water is consumed. It is further provided that meters shall be read any time during the last month of the period, and that this article is to be construed in that light; that is to say, bills shall be from reading and not necessarily from the first day of the period to the last day of the period and to enable the consumer to secure the discount within the 10 days following the rendering of the bill.
The rates to be charged are as follows: For the first 3,000 gallons per month, no charge is to be made; for all over 3,000 gallons and not exceeding 16,666 gallons, $0.35 per thousand gallons; for all in excess of 16,666 gallons and not exceeding 33,333 gallons, $0.33 per thousand gallons; for all in excess of 33,333 gallons, $0.31 per thousand gallons; subject to the discount of 10% for payment of bills within the first 10 days of the month following the period in which water is consumed.
A. 
For the purpose of building and construction work, the following flat rates will be charged: for stone, per perch of 25 cubic feet, $0.05; for tile eight by 10 by 16 inches, or eight by eight by 16 inches, per thousand, $0.15; for brick and fireproof backups, per thousand, $0.10; for plaster, per 100 square yards, $3; for cement flooring, per 100 square feet, $0.10; for concrete, per 100 cubic feet, $0.20; provided, however, that if water shall be wasted, the supply will be shut off. In order to secure water for building or construction, an application shall be accompanied by a deposit of $5, which sum is to be paid as security for all bills. The charge for turning on and off shall be included in water bills, and such bills shall be rendered as often as the Borough shall see fit and shall be payable when rendered.
B. 
If not so paid, the supply shall be discontinued. Contractors may, if they desire, purchase water by meter by paying for the meter and its installation and repair, but no free water shall be furnished. The first 50,000 gallons shall be charged for at the rate of $0.35 per thousand gallons, and thereafter at the rates provided in § 187-11.
In case any meter fails to register for any cause, the amount charged for water during such period will be estimated by the meter reader, or such other agent of the Council as shall be designated by it.
It shall be the duty of the Superintendent of the Water Works or such other person as shall be designated by the Borough Council from time to time to read the meters and make a report thereof to the Borough Clerk or to such person as may be from time to time designated by the Borough Council, which meter readings shall be placed with the Borough Clerk or other person designated by the Borough Council at least 10 days before the date when the bills are to be mailed.
If, at any time, it is found that the meter in any dwelling or establishment is inadequate in size, the Borough may require a new and larger meter, in which case the old meter shall be taken back at whatever price the same shall be worth and credited on the cost of the new, less the expense of removal and installation.
The water supply will be discontinued on August 1, 1917, to all who have not complied with this article.

A. 
Whenever, by reason of any provision of this article, the water shall be turned off from any premises, it shall not be turned on again until an additional charge of $100 is paid.

B. 
The following schedule of rates or fees for the installation of water taps on the various streets within the Borough of Baden is as follows:

C. 
Any consumer who requests a remote control water meter shall be required to pay a fee for installation of said meter, in an amount to be set from time to time by resolution of Council, said fee presently being $35.
D. 
All persons required to place a deposit prior to securing water service from the Borough shall be required to deposit the sum of $50.

No one but the Borough shall repair or replace a meter or turn water on or off at main or curb box under a penalty of not more than $20 and cost of prosecution and, in default of payment of such penalty and costs, such person shall be committed to the county jail for a period of not more than 20 days. This penalty is in addition to such penalties as are provided by law.
Prosecutions under this article may be before the Mayor of said Borough or any Justice of the Peace of the county.
The Borough will endeavor to keep an adequate supply of water in its mains at all times, but the water is furnished to the consumer upon the express condition that if for any unavoidable reason or for the purpose of making connections or for any other reason whatsoever, the water shall be temporarily shut off, no damages shall in any event be claimed by any person or persons, whether they shall be consumers or nonconsumers of water from the mains of the Borough of Baden.
