As used in this article, the following terms shall have the meanings indicated:
CRUISING
Driving a motor vehicle on a designated street or traffic artery past a traffic control point in said designated area three or more times within any one-hour period from 8:00 p.m. to 3:00 a.m. or six or more times within any three-hour period from 8:00 p.m. to 3:00 a.m., prevailing time. Passing the control point a third time or sixth time under the conditions stated herein shall constitute cruising and, therefore, a violation of this section.
DESIGNATED AREA
That area which surrounds the Westmoor Section of the Municipality of Kingston and is bounded by South Wyoming Avenue, East Market Street, Northampton Street and the Kirby Park entrance road.
TRAFFIC CONTROL POINT
A reference point designated by a sign to advise the public of this article on a street in the designated area selected by a police officer for the purpose of enforcing this article.
No person shall cruise. For the purpose of this prohibition, the person operating the vehicle shall be considered the person cruising.
This article shall not apply to any vehicle licensed to or operated by a federal, state or municipal official while on official business, any public safety or emergency vehicle or any vehicle utilized for public transportation, whether the same is a bus, taxicab or limousine.

Any person violating any provisions of this Article shall, upon summary conviction thereof in a summary proceeding before a District Justice, be sentenced for a first offense to pay a fine of not more than $200 and not less than $200 and costs and/or to be imprisoned in the Luzerne County Correctional Facility for a period not exceeding 90 days. Upon conviction of a second offense, such person shall be sentenced to pay a fine of not more than $400 and not less than $400 and costs and/or to be imprisoned in the Luzerne County Correctional Facility for a period not exceeding 90 days. Upon conviction of a third offense and any subsequent offense, such person shall be sentenced to pay a fine of not more than $600 and not less than $600 and costs and/or to be imprisoned in the Luzerne County Correctional Facility for a period not exceeding 90 days. Each and every day upon which any person shall violate or continue to violate the provisions of this Article shall constitute a separate offense.
