Upon discovery of any violation of any of the provisions of this chapter, the appropriate enforcement officials so designated by Council as provided herein, or any police officer, zoning officer or other duly authorized law enforcement officer of the Borough of Tarentum, shall cause to be issued upon the owner, occupier or other such person or persons in possession of premises subject to the provisions of this chapter, a notice directing such person or persons to remove the offending condition or to take whatever alternative measures which the Council shall deem necessary to achieve compliance with the provisions of this chapter within 10 days of the date of receipt of such notice, in default of which, at the expiration of the Ten days provided therein, a citation shall be issued subjecting such person or persons, upon the judgment of any alderman, justice of the peace or police magistrate of the Borough of Tarentum determining such violation, to pay a fine of not less than $50 nor greater than $500, and costs for each offense, and, in default of payment thereof, to imprisonment for a period not exceeding Thirty days. The penalties so provided hereunder shall be in addition to any other penalty or penalties, or other recourse whatsoever, otherwise provided to the Council by any other provisions of this chapter.
The Code Enforcement Officer shall give timely warning to any landowner that the landowner is in violation of this chapter. Once the time frame has lapsed after due notice by the Code Enforcement Officer, each day that the sidewalks and lawns are permitted to be in violation of this chapter shall count as a separate violation and subject to a separate fine and costs.
