The Board of Trustees of the Village of Carthage,
pursuant to the authority granted it under § 18 of the Public
Officer's Law and §§ 10 and 20 of the Municipal Home
Rule Law, hereby enact as follows.
The Board of Trustees of the Village of Carthage
hereby finds that defense and indemnification of officers and employees
under those circumstances outlined in § 18 of the Public
Officer's Law is an appropriate exercise of municipal authority and
is necessary to encourage people to participate in the process of
acting as officers and employees of the Village. It is the purpose
of this chapter to adopt a provision to authorize the indemnification
of officers and employees in accordance with § 18 of the
Public Officer's Law.
The Board of Trustees of the Village of Carthage hereby creates a new Chapter 4 of the Village of Carthage Code entitled "Defense and Indemnification of Officers and Employees" as follows: Pursuant to the provisions of § 18 of the Public Officers Law of the State of New York, the governing body of the Village of Carthage, New York, hereby agrees to be held liable for costs incurred under the provisions of the section by conferring upon such officers and employees of such Village the benefits of § 18 of such law.
