A. 
Terms defined. As used in this Article, the following terms shall have the meanings indicated.
PERSON
Includes any natural person, partnership, association, firm or corporation.
B. 
Word usage. As used in this Article, the singular shall include the plural, and the masculine shall include the feminine and the neuter.
No person shall use any of the streets, alleys or sidewalks in the Borough of Lehighton for any commercial or business activity; provided, however, that nothing herein shall apply to:
A. 
Any merchant who shall display any merchandise on the sidewalk, provided that the same shall not be displayed at any time between sunset and sunrise and shall not occupy any portion of the sidewalk located more than 24 inches from the building line.
B. 
Any person selling any goods, wares or merchandise from a vehicle who shall park such vehicle upon a street or alley for no longer than necessary to sell therefrom to persons residing in the immediate vicinity.[1]

C. 
A merchant who operates a restaurant and wishes to permit its customers to dine on the sidewalk in front of the restaurant immediately adjacent to the building. Such merchant must first make application to the Borough Manager and obtain a permit from the Borough Manager. The merchant shall be subject to any restrictions set forth in the permit.
