These rules and regulations shall apply to all
parks within the Town of Binghamton.
No person shall injure, deface, destroy, disturb
or remove any part of the park or any building, sign, equipment or
other property found therein, nor shall any tree, flower, shrub, grassed
area or other vegetation found therein be removed, injured, destroyed
or disturbed.
No person shall leave behind or dump any material
of any kind in a park or other public place, except the refuse, ashes,
garbage and other material from a picnic or other permitted activity,
which shall be deposited in receptacles or pits provided and marked
for such purposes.
The following conduct shall be prohibited within
the Town parks:
A. No person shall disturb the peace and good order in
the parks by fighting, quarreling or wrangling with loud voices or
shouts, threatening violence to any person or the property of others
or by engaging in clamor or boisterous shouts or conduct or tumult.
B. No persons shall collect in parks in bodies or crowds
for unlawful purposes or boisterous or riotous assemblage or for intentionally
annoying or harassing or inflicting property damage or bodily injury
upon another person or persons.
C. No person shall beg, hawk, peddle or solicit within
a park unless he or she has previously obtained a permit authorizing
such conduct from the Town Board.
D. No person shall play at disorderly games of chance
in the parks.
E. No person in any park shall possess, consume, offer
for sale, use or be under the disturbing influence of any beer, alcoholic
beverage, illegal controlled substance, stimulant, depressant or hallucinating
agent.
F. No person shall use obscene, profane or abusive language
while in a park.
G. No person shall loiter in or near toilet buildings
in a park.
H. No person, except authorized Town employees, shall
enter a toilet room set aside for the opposite sex.
I. No person shall appear in a park in a state of nudity,
in a state of dress not properly belonging to his or her sex or in
such a manner as to indecently expose his or her person.
J. No person shall commit, perform or engage in any lewd,
lascivious, obscene or indecent act or behavior in a park.
K. No person, other than the disabled owner of a trained
guide dog, shall bring into, have or keep any dog within a park during
the hours in which activities sanctioned by the Town Director of Youth
Activities are in progress unless he or she has previously obtained
a permit authorizing such conduct from the Town Board.
L. No person shall operate a motor vehicle within Jackson Park in the
Town of Binghamton, New York in excess of 10 miles per hour.

No person shall establish or maintain any camp,
sleeping place or other temporary lodging within a park unless he
or she has previously obtained a permit authorizing such conduct from
the Town Board.
No person within the confines of a park shall
hunt, pursue with dogs, trap, rob or in any way molest any wild bird,
its eggs or nest, or animal.

Use of park shelters and pavilions shall be on a first-come-first-served
basis except that park shelters and pavilions may be reserved in advance
by application submitted to the Secretary. Applications to reserve
park shelters and pavilions must be made at the office of the Secretary
at the Town Hall or in such other manner as the Town Board may specify.
In the event that the Secretary approves the application to reserve
a park shelter or pavilion, the Secretary will issue the applicant
a signed permit confirming the reservation. The fee for reserving
a park shelter or pavilion shall be $20, nonrefundable, plus a refundable
security deposit of $50, which shall be refunded provided that the
park shelter or pavilion and surrounding area are clean and left in
the same condition as they were when the person renting the shelter
or pavilion arrived. The Town Board shall establish such other rules
and procedures as it deems necessary for reservation and rental of
park shelters and pavilions.

A. All Town parks, playgrounds, athletic fields, Community Center and
concession stands shall be smoke, tobacco, cannabis, and vaping free,
with all smoking, tobacco, cannabis and vaping use prohibited in such
areas.
B. Notwithstanding the prohibitions of Subsection
A above, the parking lots of the Town parks shall be designated smoking areas.

A person violating any provision of this article
shall be subject to a fine of not to exceed $250 or to imprisonment
for not more than 15 days, or both, for each offense.
