Heavy Towing

A. Heavy towing service rates
(1) General rates
(a) Rate, billed in thirty-minute increments.

A. 
Purpose. The purpose of the payment-in-lieu ordinance is to establish a mechanism to provide funding for the construction of affordable housing within the Township of Little Falls for zone districts where the Zoning Ordinance[1] permits that affordable housing obligations may be satisfied through a payment in lieu of constructing the units on site. The mechanism contained within this section is intended to require the developer or redeveloper of a project to provide a fee in the amount of the actual cost of constructing or subsidizing the construction of his or her prorated share of affordable housing units within Little Falls Township, including hard and soft costs.

B. 
Payments in lieu of constructing affordable housing in inclusionary zones.
(1) 
Payments in lieu of the construction of affordable housing shall be based upon the prorated share of the actual cost to the Township to create or subsidize the creation of an affordable housing unit within the Township, using any of the eligible options for the provision of affordable housing permitted under applicable affordable housing regulations, provided said options are also consistent with the zoning regulations of the Township of Little Falls and/or with an applicable adopted redevelopment plan. Both hard and soft costs shall be included in the calculation. The payment amount shall be calculated by the applicant based upon a proportionate share of the total project cost embodied in one or more pro formas for the construction of affordable housing elsewhere within Little Falls, if such pro formas have been prepared and are on file in the office of the Township Clerk, or shall be negotiated between the Township and the developer or redeveloper as the case may be. In no case shall the negotiated amount be less than the actual cost to the Township to create or subsidize the creation of the amount of affordable housing units required for the project under consideration, including both hard and soft costs.
(2) 
In negotiating the amount of a payment-in-lieu for a fraction of a unit, the Township may require the preparation of a pro forma by the developer or redeveloper, to be reviewed by an independent third-party entity at the expense of the developer or redeveloper, to confirm that the amount of the payment-in-lieu accurately reflects the realistic costs of providing an affordable unit in Little Falls. Fractional units must be calculated out to include a minimum of two decimal places.
(3) 
This section is applicable to applications for development proposed to be located within inclusionary zones located within Little Falls Township that permit the applicant to utilize a payment-in-lieu-of-construction option to satisfy the affordable housing obligation for his or her project.
(4) 
Fifty percent of the payment-in-lieu fee shall be paid prior to the issuance of the certificate of occupancy for the first housing unit within the market rate development for which payment in lieu of construction is required. The remaining 50% of the payment-in-lieu fee shall be paid in full prior to the point at which 50% of the housing units in the market rate housing development have received a certificate of occupancy. In cases where only one market rate single-family unit is proposed, the applicant shall pay 100% of the payment-in-lieu-of-construction fee prior to the issuance of the final certificate of occupancy.
