GENERAL REFERENCES
Vehicles and traffic — See Ch. 264.
Every person riding a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard upon a street or roadway of the Village shall be subject to the provisions of Chapter 264, Vehicles and Traffic, of this Code which are applicable to the driver of a vehicle, except as to specific regulations contained in this chapter and except as to those provisions of said chapter which by their nature can have no application.
Any person operating a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard upon the public ways of the Village shall obey the instructions of police officers, traffic signals, signs and other controlled devices applicable to a vehicle unless otherwise directed by a police officer.
No person riding a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard shall drive the same or coast upon any street or sidewalk or proceed with the feet off the pedals or without at least one hand on the handlebars or steering apparatus or perform any trick or fancy riding upon any street or place in the Village.
No person shall operate a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard at a speed greater than is reasonable and prudent under the conditions existing at the time and place.
A. 
Manner. A person operating a bicycle, bicycle with electric assist, or electric scooter shall not ride other than upon or astride the permanent or regular seat attached thereto.
B. 
Passengers. The operator of a bicycle, bicycle with electric assist, or electric scooter shall not carry another person upon such bicycle other than upon a firmly attached and regular seat thereon.
Every person operating a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard on a roadway shall ride as near the right-hand side of the roadway as practical and exercise due care when passing a standing vehicle or one proceeding in the same direction.
The operator of a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard emerging from an alley, driveway or building, upon approaching a sidewalk or the sidewalk area extending across any alley or driveway, shall stop and yield the right-of-way to all pedestrians on said sidewalk or sidewalk area and, upon entering the roadway, shall stop and yield the right-of-way to all vehicles approaching on said roadway.
No person shall park a bicycle, bicycle with electric assist, or electric scooter upon a street excepting upon the roadway against the curb or upon the sidewalk in a rack to support the bicycle, bicycle with electric assist, or electric scooter; neither shall a bicycle, bicycle with electric assist, or electric scooter be parked against a building in such a manner as to obstruct pedestrian traffic.
No person riding upon any bicycle, bicycle with electric assist, electric scooter, rollerblades, or skateboard shall attach the same or himself or herself or hang onto any other moving vehicle.
Any person riding a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard in company with others on bicycles, bicycle with electric assist, electric scooter, rollerblades, or skateboards must ride in single file.
No person operating a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard shall carry any package, bundle or article which obstructs the view of the operator or which prohibits him or her from keeping at least one hand on the handlebars.
A. 
No person shall ride a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard on a sidewalk within any of the business sections of the Village.
B. 
No person 12 years or more of age, other than newspaper carriers on delivery routes, shall ride a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard upon any sidewalk in the Village.
C. 
Whenever any person is riding a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard upon any sidewalk, such person shall yield the right-of-way to all pedestrians and shall give an audible signal before overtaking and passing such pedestrian.
All persons are prohibited from riding a bicycle, bicycle with electric assist, electric scooter, rollerblades, or a skateboard in any public park or playground.
When any bicycle, bicycle with electric assist, or electric scooter is parked, abandoned or kept motionless on any sidewalk, not in accordance with § 108-8 hereinabove described, said bicycle, bicycle with electric assist, or electric scooter may be removed by the Village of Johnson City Police.
A. 
When any bicycle, bicycle with electric assist, or electric scooter is found unattended on any public highway in the Village of Johnson City where such bicycle constitutes an obstruction of traffic, such bicycle, bicycle with electric assist, or electric scooter may be removed by the Village of Johnson City Police.
B. 
When any bicycle, bicycle with electric assist, or electric scooter is parked or abandoned within the Village of Johnson City where parking, stopping or standing is prohibited or said bicycle, bicycle with electric assist, or electric scooter is parked upon private property without the consent of the owner of such property, such bicycle, bicycle with electric assist, or electric scooter may be removed by the Village of Johnson City Police.
C. 
Any bicycle, bicycle with electric assist, or electric scooter operated or possessed in violation of this chapter may be removed by the Village of Johnson City Police.
A. 
Prior to releasing any bicycle, bicycle with electric assist, or electric scooter removed by the Village of Johnson City Police under the authority of the preceding sections, the alleged owner of the bicycle, bicycle with electric assist, or electric scooter shall execute a sworn affidavit, under penalty of perjury, describing the bicycle, bicycle with electric assist, or electric scooter and alleging ownership of the bicycle, bicycle with electric assist, or electric scooter by the affiant. Such sworn statements shall be a record kept and maintained by the Village of Johnson City Police Department.
B. 
The owner of the impounded bicycle, bicycle with electric assist, or electric scooter shall also be required to pay an impound charge for the removal, a charge for attempting to notify the owner and a storage fee for every day after removed, such total amount to be paid to the desk sergeant before release of the bicycle, bicycle with electric assist, or electric scooter. Such charges and fees shall be set by resolution of the Village of Johnson City Board of Trustees.
C. 
An impound form shall be used by the Village of Johnson City Police for each removal.
D. 
Redemption of any bicycle, bicycle with electric assist, or electric scooter shall be made from the Village of Johnson City Police Department during the hours of 8:30 a.m. to 3:30 p.m., Monday through Friday, excluding holidays.
The disposition of any unclaimed bicycle, bicycle with electric assist, or electric scooter shall be governed by Article 7-B of the Personal Property Law as may be modified by resolution of the Village of Johnson City Board of Trustees pursuant to General Municipal Law § 250.
