[HISTORY: Adopted by the Board of Trustees of the Village of LeRoy 6-22-1965 as Article VIII of Chapter III of the Village Ordinances. Amendments noted where applicable.]
A. 
It shall be unlawful for any minor under the age of 17 years to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, wharves, docks or other public grounds, public places and public buildings, places of amusements and entertainment, vacant lots or other unsupervised places, between the hours of 10:00 p.m. and 6:00 a.m. of the following day; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parents, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other person having the care and custody of the minor.
B. 
Each violation of the provisions of this section shall constitute a separate offense.

It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of 17 years to knowingly permit such minor to loiter, idle, wander, stroll or play in or upon the public streets, highways, alleys, roads, parks, playgrounds, wharves, docks or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between the hours of 10:00 p.m. and 6:00 a.m. of the following day; provided, however, that the provisions of this section do not apply when the minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.
B. 
Each violation of the provisions of this section shall constitute a separate offense.
Any minor violating the provisions of § 89-1 shall be dealt with in accordance with Family Court law and procedure. Any parent, guardian or other adult person having the care and custody of the minor violating § 89-2 shall be fined not less than $50 or be imprisoned for not more than 10 days or be punished by both said fine and imprisonment for each offense.
