The developer, before the approval of the subdivision
plat, shall complete all improvements to the satisfaction of the Highway
Superintendent, the Water and Sewer Superintendent, and any other
inspector which may be appointed by the Planning Board or Town Board,
or shall post a performance bond or other surety in a form acceptable
to the Town Board which is sufficient to ensure the satisfactory completion
of the following required improvements. The Planning Board may grant
requests for waivers, subject to appropriate conditions. All such
improvements shall comply with the Subdivision Road and Development
Specifications on file in the Town Clerk's office.
Streets, curbing and gutters shall be constructed,
graded, and paved in accordance with the Subdivision Road and Development
Specifications on file in the Town Clerk's office.
Storm drains, culverts, catch basins, and other
drainage structures shall be installed in accordance with the Subdivision
Road and Development Specifications on file in the Town Clerk's office. All pipe shall comply
with the requirements of the current New York State Highway Department
specifications governing construction of these facilities. The location,
length, depth, size, grade, and type of pipe shall be designated in
the plans. If unusual conditions are discovered at the time of construction,
which are not provided for on the plans, the Town Highway Superintendent,
or other parties as designated by the Planning Board, shall determine
the type and extent of construction required to overcome such conditions.
Sidewalks shall be required on both sides of
the street.
Driveway aprons shall be required between the
curbing and the sidewalk. Driveway aprons shall be of six-inch concrete
meeting the same specifications established for curbing.
Street signs shall be installed at the intersection
of all streets in conformity with town specifications at the locations
approved by the Planning Board.
Grass strips shall be provided within the portion
of the street right-of-way beyond the curbline or gutter line and
shall be properly graded and seeded.
The developer shall plant street trees in every
subdivision at intervals from 40 to 60 feet along both sides of the
street. Existing trees may be taken into consideration when determining
the above. Trees shall be at least three feet from any sidewalk and
located on the building side of the walk rather than the street side.
Where dwelling structures are oriented with their rear on the street,
street trees shall be at least six feet from the curbline. The average
trunk circumference shall be seven inches and an average height of
six feet above finished grade is required. Such trees shall be of
a species and at locations approved by the Planning Board. No tree
shall be planted within 25 feet from an existing or proposed streetlight
or street intersection.
In addition to the required street trees, the
developer shall plant within each subdivision lot a minimum of two
shade trees. Existing trees may be taken into consideration when determining
the above. The average trunk circumference shall be at least seven
inches with an average height of six feet. Such trees shall be of
a species and at locations approved by the Planning Board.
Streetlighting facilities shall be required.
Streetlighting facilities shall be provided along all streets in the
subdivision and along all streets upon which the subdivision abuts.
Lighting facilities shall be installed as approved and directed by
the Town Highway Superintendent.
Sanitary sewers and waste treatment disposal facilities shall be required where a public sanitary sewer is reasonably accessible. The developer shall connect or provide for connection with such sanitary sewer and shall provide within the subdivision the sanitary sewer system required to make the sewer accessible to each lot in the subdivision. Sewage disposal systems shall be approved by the New York State Department of Health, the Code Enforcement Officer and applicable Watershed Inspector as per §
116-43 of these regulations, the Sewer and Water Superintendent, and other Town Health Officials, where appropriate. The construction is subject to the supervision of the Code Enforcement Officer and applicable Watershed Inspector, the Town Sewer and Water Superintendent, or the appropriate health agencies as determined by the Planning Board.
The developer shall connect with a public water
main where a public water main is reasonably accessible. The developer
shall provide a water connection for each lot in accordance with town
standards, procedures, and supervision. Fire hydrants shall be required
and shall be installed in the location approved by the Town Sewer
and Water Superintendent, the Fire Chief, and other appropriate entities
as specified by the Planning Board, and in accord with the New York
State Board of Fire Underwriters. The New York State Department of
Health review will be required where specified by New York State statute
or regulation.
Permanent monuments shall be set at block corners
and at intervals of approximately 500 feet, or such other distance
as the Planning Board may determine appropriate, and their location
shall be shown on the subdivision plat. Monuments shall also be set
to mark all underground utilities. Iron pipes shall not be considered
permanent monuments for the purpose of these regulations.
All utilities within major subdivisions shall
be installed underground.
