There is hereby established the position of the Director of the Police Department of the City of Vineland, who shall be designated and known as the "Director of Public Safety."
The Director shall be appointed by the Mayor of the City of Vineland, with the advice and consent of the City Council.
The Director shall be appointed for and shall serve during the term of office of the Mayor appointing him and until the appointment and qualification of his successor.

The Director shall receive an annual salary and mileage and/or other transportation compensation, to be paid in the same manner as other department heads and officers of the City of Vineland. The current salary is set forth in Chapter 157, Salaries and Compensation.

No person shall be qualified for appointment as Director of the Police Department unless such person shall be of high moral character and shall not have been convicted of a crime as defined in N.J.S.A. 2C:1-4 or shall not have been convicted of a disorderly or petty disorderly offense in the past 10 years. Furthermore, no person shall be qualified for appointment as Director of the Police Department unless such person shall have:
A. 
Ten years' administrative business experience and have a high school diploma or its equivalent; or
B. 
Five years' experience in business administration for a governmental agency and have attained a Master of Business Administration; or
C. 
Five years in the rank of lieutenant or greater in law enforcement; or
D. 
Three years in the rank of lieutenant or greater in law enforcement; and
(1) 
Has a post-secondary education in public administration, criminal/justice studies or similar degree from an accredited institution; and
(2) 
Advanced law enforcement administrator training from a recognized agency; or
E. 
Has attained the rank of E-9 or higher in the military service for a period of five years and remains in such rank or has been honorably discharged from the military service.

The Director of Public Safety shall be required to serve in that capacity for such time as necessary to carry out the duties of the Director of Public Safety as specified herein.

A. 
The Director shall possess all of the general appointment and supervisory powers granted to department heads pursuant to N.J.S.A. 40:69A-43 and is designated the appropriate authority pursuant to N.J.S.A. 40A:14-118. The Director shall have complete responsibility for the fiscal and administrative affairs of the Police Department, including the authority to:
(1) 
Adopt and promulgate rules and regulations for the government of the Police Department and for the discipline of members.
(2) 
Provide for the health, safety or welfare of the City in an emergency situation through special emergency directives.
(3) 
Prepare budget requests and administer the departmental budget.
(4) 
Appoint police officers and employees of the Department.
(5) 
Approve or disapprove payrolls, bills and claims chargeable to the Department appropriations.
(6) 
Provide such information reports on the work of the Department as may from time to time be required by the Mayor.
(7) 
Preside at all departmental hearings and remove or suspend police officers and employees of the Department as provided by law.
(8) 
Perform such other duties as directed by the Mayor, not inconsistent with applicable ordinances and statutes.
(9) 
Examine at any time the operations of the Department or the performance of any officer and members.
B. 
The Director shall exercise all powers and duties conferred by ordinances of the City of Vineland with respect to license application and approval, except where expressly reserved to the Chief of Police by law.

The Chief of Police shall be the head of the Police Department and shall be directly responsible to the Director for the efficiency and routine day-to-day operations of the Department. The Chief of Police shall, pursuant to policies adopted by the Director:
A. 
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the Department and its officers and personnel.
B. 
Have, exercise and discharge the functions, powers and duties of the Department.
C. 
Prescribe the duties and assignments of all subordinates and personnel.
D. 
Delegate such of his authority as he may deem necessary for the efficient operation of the Department to be exercised under his direction and supervision.
E. 
Report at least monthly to the Director, in such form as shall be prescribed by the Director, on the operation of the Department during the preceding month and make such other reports as may be requested by the Director.
The Department of Public Safety heretofore established by Ordinance No. 6 is hereby abolished.
