A.Â
The sale or furnishing of tobacco products to persons under age 18
is prohibited.
B.Â
Sellers of tobacco products may demand proof of the buyer's age by
a U.S. military identification card, photographic driver's license,
valid passport or a photographic nondriver motor vehicle identification
card. These are the only forms of identification sellers of tobacco
products are authorized to use for age verification.
C.Â
Violators will be fined up to $100 for the first offense and up to
$500 for any subsequent offense.
A.Â
The purchase or possession of tobacco products on any public property
or any private property open to the public by persons under the age
of 18 is prohibited, unless the person is an employee of an establishment
authorized to sell such products.
B.Â
A person who possesses tobacco products in violation of this chapter
is subject to immediate confiscation of the tobacco products and a
fine of $25. The police or peace officer enforcing the provisions
of the statute shall make parental notification, in writing, of a
person under the age of 18 who violates this chapter.
A person less than 18 years of age who misrepresents his or
her age by presenting false identification to purchase tobacco products
shall be fined up to $50 and/or provide up to 10 hours of community
service.
