For the purpose of promoting the health, safety and general welfare of the residents of the Village of Otego, it is hereby declared to be the policy of the Village of Otego to prohibit the accumulation of trash or garbage and refuse on private property. It is also the policy of said Village and the purposes of this article to require persons engaged in the collection of garbage and refuse within the Village of Otego to obtain from the Village of Otego a license to carry and dispose of garbage and refuse.

A.
Except where specifically defined herein, all words used in this article shall carry their customary meanings. Words used in the present tense include the future, and the plural includes the singular.
B. GARBAGE, TRASH AND REFUSE
As used in this article, unless the context or subject matter otherwise requires, the following words shall have the meanings indicated:

Include both combustible and incombustible waste materials such as the waste of meat, fish, fruits, vegetables or vegetable matter, including tin cans that have contained food material, and paper, wood, leather, cloth or any other combustible matter, and ashes, glass, metals or other incombustible refuse.

A.
Required. Every householder shall provide metal/plastic receptacles with overlapping and tight-fitting covers. Such receptacles shall be kept securely covered in such manner as to exclude dogs, rats and flies, and their contents shall be removed at least once weekly. Cans must be kept in a good, clean and sanitary condition free of leaks and dents which prevent tight closings and shall not be permitted to have any ragged or sharp edges to hinder or harm the person handling the contents thereof. Such receptacles when filled shall not exceed 39 gallons in capacity or 50 pounds in weight.
B.
Exceptions. Exceptions may be made for householders who dispose of their garbage and refuse by means of a grinding machine or acceptable household garbage disposal unit. Nonputrescible material if compactly stored or tied in bundles or properly weighed down need not be placed in metal/plastic containers.
A.
Providing and care of proper receptacles. It shall be the duty of the householder or other person whose garbage and refuse is being disposed of as herein provided to furnish approved metal/plastic receptacles to hold the garbage and refuse accumulations between the periods of collection and to keep the receptacles covered at all times when in use with proper tight-fitting metal/plastic covers except while garbage and refuse is being put into such receptacles or while the same are being emptied.
B.
Scavenging prohibited. It shall be unlawful for anyone other than the tenants, landlord, or occupants of the premises at which garbage and refuse are stored, licensed garbage and refuse collectors and their employees, or a duly authorized representative of the Village to disturb any receptacle or to remove the cover or any of the contents thereof or any material stored for disposal.
C.
Scattering of contents. It shall be unlawful for any person to strew or scatter the contents of any receptacle containing garbage or refuse on the lawn, sidewalk, street, waterway, stream, empty lot or other public or private place in the Village of Otego.
No person shall engage in the collection of garbage and refuse within this Village without first obtaining from the Village a license to carry and dispose of garbage and refuse. The fee for a license under this article shall be set from time to time by resolution of the Board of Trustees and shall be payable at the time of application for such license.
Any person applying for a license to collect garbage and refuse shall make said application, in writing, to the Village Clerk upon forms to be supplied by the Village, stating the name and residence or place of business of said applicant, and a description of the conveyance to be used for the collection of said garbage and refuse, which conveyance must be approved by the Village Board of Trustees.
All licenses shall be issued by the Village Clerk and shall be granted for a term to end on December 31 next following the granting thereof.
Any conveyance used in the collection and conveyance of garbage and refuse in the Village shall have thereon the names of the owner or owners and the number of license.
The equipment to be used by collectors of garbage or refuse shall be so constructed as to make impossible the spilling of any refuse, and in transporting such garbage and refuse through the Village streets to the landfill, all trucks shall be covered in such manner that none of the contents can spill on the Village streets. During the process of loading, trucks may be uncovered but any garbage or refuse falling to the streets must be cleaned up immediately.
The Village Board of Trustees may make such additional rules and regulations as it deems necessary to carry out the intent of this article pertaining to the licensing of collectors, collection and disposal of garbage and refuse, trash and rubbish. Any violation of such rules or regulations shall be a violation of this article.
Any person who shall violate this article shall be subject to conviction of an offense by a court of competent jurisdiction and shall be subject to a fine of not more than $250 or by imprisonment for not more than 15 days, or both, for each and every violation. The term "person" as used herein shall include owners, occupants, tenants, lessees, trustees, corporations, agents, firms or associations directly or indirectly in control of the property, operations or any part thereof.

The plan for collection and disposal of waste and recyclable materials for the Village of Otego, New York, shall be as follows.
All residents within the Village of Otego may use the southern Otsego County Transfer Station, located at the junction of Route 205 and County Route 48, Oneonta, New York. All solid wastes and recyclable materials may be delivered to the aforesaid transfer station. Construction and demolition debris may be taken to the same landfill. All residents shall obtain a permit, available at the transfer station, for use of the transfer station when not utilizing the services of a private hauler.
The Village will not provide curbside pickup of solid waste and recyclables. Residents of the Village are responsible for contracting individually with private haulers or to personally transport their solid waste and recyclables to the transfer station.
The disposal of major appliances, mattresses, tires, and household furnishings will be the responsibility of individual residents and businesses.
The Village will provide pickup on Mondays for bagged leaves, grass clippings and brush.
Any person who shall violate this article shall be subject to a fine of not more than $250 or by imprisonment for not more than 15 days, or both.
