For the purposes of §§ 7-728 through 7-732 of the Village Law of the State of New York, inclusive, and for the purposes of § 335 of the Real Property Law of the State of New York, a "subdivision" in the Village of Patchogue is hereby defined as the division of any parcel of land into two or more lots, blocks or sites for the purpose of resale with or without the creation or extension of streets or highways.
No building permit in connection with any lot which is the result of a subdivision as defined above shall be granted unless and until said subdivision has received the approval of the Village Planning Board pursuant to regulations referred to below.
The Village Planning Board is hereby authorized to waive requirements of this chapter and of the sections of the Village Law and Real Property Law of the State of New York referred to above where the proposed subdivision contains less than five lots and does not involve the laying out of a street or the extension of a previously laid out street or the extension of any municipal facilities pursuant to regulations referred to below.
The Planning Board of the Village of Patchogue is hereby empowered to adopt and amend regulations governing the approval, modification or disapproval of subdivisions; subject, however, to the approval of same by the Board of Trustees; and each and every amendment to any such regulations shall also be subject to the approval of the Board of Trustees. Such approval by the Board of Trustees shall be by resolution without the necessity of any public hearing or notice.

A stormwater pollution prevention plan consistent with the requirements of this Code shall be required for preliminary subdivision plat approval. The SWPPP shall meet the performance and design criteria and standards in Article XV, Stormwater Control, of Chapter 435, Zoning. The approved preliminary subdivision plat shall be consistent with the provisions of L.L. No. 6-2009.[1]
