This article is enacted in recognition of the fact that the Town of Richmond has from time to time attempted to assist its resident taxpayers by providing a place or places where solid waste, commonly referred to as "garbage or rubbish," can be deposited after which it is disposed of by agents and/or employees of the town. It is the intent of this article to enable the Town Board to adopt by resolution, from time to time, as it sees fit, regulations governing the use of those facilities as are provided by the Town of Richmond for collection of solid waste.
The Town Board of the Town of Richmond may designate by resolution one or more appropriate locations upon lands now or hereafter owned, leased or controlled by the Town of Richmond as disposal sites for rubbish and/or garbage by or on behalf of the residents of the Town of Richmond.
Effective from and after such dates as may be established by resolution of the Town Board, and thereafter during such times as the Town Board shall require the same, no person shall leave or deposit any rubbish or garbage at any disposal site in the Town of Richmond unless such person shall have been issued an applicable permit so to use such disposal site. The Town Board may provide for classes of permits for uses of such disposal sites and establish appropriate fees.
The Town Board may, by resolution, adopt regulations for the use, manner of use, times of use and access to any disposal site. Such regulations may require the separation by permit holders of rubbish from garbage and the deposit of either separate from the other on the same or at different disposal sites; prohibit and regulate at any or all sites the deposit of any item exceeding such volume or weight as shall be determined by the Town Board to be in excess of the handling capacity of the disposal facility; prohibit or regulate the deposit of raw sewage and any and all waste material taken from sewage disposal systems, settling beds, septic tanks, cesspools or outside toilets at any or all disposal sites; and prohibit or regulate the deposit of motor vehicles or automobiles or parts thereof, farm or other machinery, pipes, tree limbs and stumps, stoves, refrigerators, washing machines and like appliances and machinery, dead animals and offal and all other objects the uncontrolled deposit of which the Town Board shall find likely to adversely affect the health, safety and welfare of the users of any disposal site or others or cause inequitable expenses to the taxpayers of the Town of Richmond.
During such times as permits shall be required of any person so to do, no such person shall deposit any rubbish or garbage at any disposal site operated, maintained or designated by the Town Board of Richmond, except such persons as shall have a valid permit therefor issued pursuant to this article. No person shall deposit any rubbish or garbage at any disposal site or elsewhere in the Town of Richmond except at such times and in such places as shall be designated for such purpose by the Town Board or permitted by other law or ordinances, and then only in accordance with the rules and regulations governing use of such disposal sites as the same shall be adopted or amended by resolution of the Town Board and posted at such disposal site. No person shall deposit, at any place in the Town of Richmond, except in accordance with the local laws and ordinances of the Town of Richmond, any rubbish or garbage collected, or originating as rubbish or garbage, outside the Town of Richmond.

Any person who violates this article shall be guilty of a violation, and upon conviction thereof, shall be subject to a fine of not less than $100, and not more than $500, or imprisonment for a term not to exceed 15 days, or both.
Any resolution of the Town Board authorized by this article may be adopted without public notice or public hearing.
