A.
No person shall excavate, grade or fill any private property involving an area of more than 10% of the plot area or do any construction in such a manner as to change the existing ground elevation by more than one foot without first applying for and obtaining a permit from the Building Department. The fee for and duration of such permit shall be as set forth in Chapter 125, Fees and Deposits. Such fee shall accompany each application, which shall be in writing and shall be filed with the Building Inspector. The form for such application shall be as prescribed by the Building Inspector.

The foregoing provisions of this section notwithstanding,
no permit shall be required where excavation, grading and filling
work is being done under a building permit.
A.
Applications for excavation, grading and filling permits
shall be made to the Building Inspector, on forms provided by the
Building Department, and shall be accompanied by specifications and
a plot diagram, drawn to scale, showing:

The Building Inspector shall review all applications
for excavation, grading and filling permits, including pertinent portions
of applications for building permits, to determine if the site of
the proposed improvement will be reasonably safe from mudslides and
to make recommendations in all mudslide areas.
C.
If the Building Inspector determines that a site is
in a location that may have mudslide hazards, he shall, in addition
to his own recommendations, refer the application for further review
by persons qualified in geology and soils engineering. The proposed
excavation, grading and filling must thereafter be performed in such
manner as not to aggravate the existing hazard and to adequately protect
the site and proposed improvements against mudslide damage.
