The purpose of this article is to create and establish
a Planning Commission for the Township of Upper Southampton pursuant
to the provisions in Pa. Act 247, Municipalities Planning Code.[1]
There is hereby created and established in the Township
of Upper Southampton a Township Planning Commission to be known as
the "Upper Southampton Township Planning Commission" (hereinafter
referred to as "Planning Commission"), consisting of seven members,
who shall reside within the Township and who shall serve without compensation,
but may be reimbursed for necessary expenses. At least five members
of the Planning Commission shall be designated citizen members, which
means they shall not be officers or employees of the Township.
The members of the Planning Commission shall be appointed
by the Board of Supervisors for the term of four years, or until a
successor is appointed and qualified, except that the terms of the
members first appointed, pursuant to this amendment, shall be fixed
so that no more than two members of the Commission shall be reappointed
or replaced during any future calendar year. The members of the existing
Planning Commission shall continue in office until the end of the
term for which they were appointed.[1]
Editor's Note: Former § 262, Subsection 3, regarding the names of the first members of the Planning Commission, which immediately followed this subsection, was deleted at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
The Planning Commission shall have all the powers
and duties conferred and imposed upon it as set forth in the Municipalities
Planning Code, as if said provisions were fully set forth herein.
