This article shall be known as "the Uwchlan
Township Plumbing Code."
A certain document, three copies of which are on file in the office of the Zoning Officer of the Township of Uwchlan, being marked and designated as "The BOCA National Plumbing Code, Ninth Edition, 1993," as published by The Building Officials and Code Administrators International, Inc., is hereby adopted as the Plumbing Code of the Township of Uwchlan in the State of Pennsylvania for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 106-13 of this article.
Ordinance No. 90-17 of the Township of Uwchlan,
entitled "Uwchlan Township Plumbing Code," and all other ordinances
or parts of ordinances in conflict herewith are hereby repealed.

The following sections are hereby revised as
follows:
Insertions:
§ P-101.1. Title: These regulations
shall be known as the Plumbing Code of Uwchlan Township hereinafter
referred to as "this code."
§ P-113.2. Fee schedule: The fees
for all plumbing work shall be as set from time to time by resolution
of the Board of Supervisors.[1]
§ P-116.4. Violation penalties: Any
person who violates or permits the violation of any provision of this
code or fails to comply with any of the requirements thereof or who
shall erect, install, alter or repair plumbing work in violation of
the approved construction documents or directive of the Code Official,
or of a permit or certificate issued under the provisions of this
code, shall, in addition to any other remedy available under law or
equity, be subject to a criminal fine not to exceed $1,000, plus the
costs of prosecution, including reasonable attorneys' fees, for each
violation. In default of payment thereof, the defendant may be sentenced
to imprisonment for a term no exceeding 90 days. Each twenty-four-hour
period during which failure to comply continues after due notice has
been served shall constitute a separate offense. Enforcement of this
ordinance shall be by action brought before a Magisterial District
Judge in the same manner provided for the enforcement of summary offenses
under the Pennsylvania Rules of Criminal Procedure. The Township's
Solicitor may assume charge of the prosecution without the consent
of the District Attorney.[2]
§ P-117.2. Unlawful continuance: Any
person who continues work in or about the structure having been served
with a stop-work order, except such work as that person is directed
to perform to remove a violation or unsafe condition, shall, in addition
to any other remedy available under law or equity, pay a criminal
fine in an amount not less than $1,000, plus the costs of prosecution,
including reasonable attorneys' fees, for each violation. In default
of payment thereof, the defendant may be sentenced to imprisonment
for a term no exceeding 90 days. Each twenty-four-hour period during
which failure to comply continues shall constitute a separate offense.
Enforcement of this ordinance shall be by action brought before a

§ P-304.3. Public systems available:
A public water main or public sewer system shall be considered available
to a structure where the structure is located within 150 feet of the
public water man or sewer.
§ P309.4. Freezing. Water service
piping shall be installed below recorded frost penetration but not
less than four feet by zero inch below grade. In climates with freezing
temperatures, plumbing piping in exterior building walls or areas
subjected to freezing temperatures shall be protected against freezing
by insulation or heat or both.
§ P-309.5. Sewer depth: Building sewers
that connect to private sewage disposal systems shall be a minimum
of 36 inches below finished grade at the point of septic tank connection.
Building sewers shall be a minimum of 36 inches below grade.
Ordinance No. 90-17, dated November 12, 1990,
of Uwchlan Township is hereby repealed.
Nothing in this article or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 106-12 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
