This Article shall be known and referred to as the "Anti-Scavenging Ordinance" of the Borough of Westmont.

A. GARBAGE HAULER OR PRIVATE COLLECTOR PERSON REFUSE RUBBISH SCAVENGING
The following words and phrases, as used in this article, shall have the meanings ascribed herein, unless the context clearly indicates a different meaning:
Refuse, except rubbish, or waste of any kind.
Any person, firm, copartnership, association or corporation who has been licensed by the Borough of Westmont or its designated representative to collect, transport and dispose of refuse for a fee in the Borough of Westmont.
Any individual, partnership, corporation, association, institution, cooperative enterprise, municipal authority, federal government or agency, state institution and agency or any other legal entity which is recognized by law as the subject of rights and duties. In any provisions of this article prescribing a fine, imprisonment or penalty or any combination of the foregoing, the term "person" shall include the officers and directors of any corporation or other legal entity having officers and directors.

All solid waste materials which are discarded as useless.
All nonputrescible municipal waste, except garbage and other decomposable matters. This category includes but is not limited to ashes, bedding, cardboard, cans, crockery, glass, paper, wood and yard cleanings.
The unauthorized and uncontrolled sorting, gathering, collecting, extracting, removal, reclamation or disturbance of garbage, rubbish or refuse materials placed at the curb for collection.
B.
In this article, the singular shall include the plural and the masculine shall include the feminine and the neuter.
A.
It shall be unlawful for any person other than an owner, hauler or private collector to haul, transport, collect or remove any garbage, refuse or rubbish from public or private property within the Borough of Westmont without first securing a license to do so from the Borough of Westmont.
B.
It shall be unlawful for any person other than an owner, hauler or private collector to scavenge any materials from any garbage, refuse or rubbish that is stored or disposed for collection within the Borough of Westmont without the prior approval of the Borough of Westmont.
C.
It shall be unlawful for any person other than an owner, hauler or private collector to sift, sort, separate, remove, scavenge, take possession of or otherwise disturb any garbage, refuse or rubbish on public or private property.

Any person who violates any provision of this article shall, upon conviction, be guilty of a summary offense, which is punishable by a fine of not more than $300 or, in default of payment of such fine, then by imprisonment for a period of not more than 90 days, or both. Each day a violation occurs shall be considered a separate and distinct offense.
The Westmont Borough Council may suspend this article for designated periods such as for the annual trash cleanup days.
