A.
Legislative intent. By the adoption of this article,
the Village of Woodbury declares its intent to regulate the parking
of motor vehicles on any public street within the Village of Woodbury
from November 15 to April 15 of every year. This article is enacted
in order to facilitate the proper removal of snow and ice accumulations
on any public street within the Village of Woodbury. Reference is
made to the Municipal Home Rule Law of the State of New York § 22
for legislative authority to so enact this article.
B.
Definitions.
(1)
The words and phrases and definitions of words as
used in the New York State Village Law shall be applied in the enforcement
of this article.
(2)
PARKING
SNOW AND/OR ICE PRESENT
STANDING
Additionally, specific reference is made to the following
definitions:
Leaving a motor vehicle with its motor off, occupied or not
occupied, or any other vehicle in a stationary position within limits
of a public street other than for the purpose of and while actually
engaged in the loading or unloading of merchandise or receiving or
discharging passengers.
When it is snowing, sleeting, freezing rain or there is an
accumulation of the same on the paved portion of the Village roadway.
Leaving a motor vehicle with its motor on, occupied or not
occupied, or any other vehicle in a stationary position within limits
of a public street other than for the purpose of and while actually
engaged in the loading or unloading of merchandise or receiving or
discharging passengers.
A.
During the following period, November 15 to April
15 of each calendar year, it shall be unlawful for any person to park
a motor vehicle or to allow that vehicle to remain parked anywhere
on any public street in the Village of Woodbury when snow and/or ice
is present.
B.
In order to assist the operators of motor vehicles
in the Village of Woodbury, signs shall be placed on any street leading
into the Village of Woodbury with the wording, "No Parking on Any
Street in the Village of Woodbury From November 15 to April 15 When
Snow and/or Ice is Present."
A violation of this article, upon conviction,
is punishable by a fine of up to $250. In addition, the Town Police
Department is authorized to have the vehicle towed away at the owner's
expense. The Town Police Department shall not release any such vehicle
so removed until the cost, as certified to the Town Police Department,
of removal towing and storage shall have been paid in full. The continuance
of an offense for each day (24 hours) shall be deemed a distinct and
separate violation.
