Any officer, department, board or bureau of
the Village, with the approval of the Village Board, or any person
or persons, jointly or severally, aggrieved by any decision of the
Planning Board concerning a plat decision, may bring a proceeding
to review in the manner provided by Article 78 of the Civil Practice
Law and Rules in a court of record on the ground that such decision
is illegal, in whole or in part. Such proceeding shall be commenced
within 30 days after the filing of the decision in the office of the
Board. Commencement of the proceeding shall stay proceedings pending
a final decision from the New York State Supreme Court.
Whenever the requirements of this Part 2 are
at variance with the requirements of any other lawfully adopted rules,
regulations or ordinances, the most restrictive or that imposing the
higher standards shall govern.
This Part 2 shall be enforced by the Village
Planning Board. No building permit or certificate of occupancy shall
be issued by the Code Enforcement Officer except where all the provisions
of this Part 2 have been complied with.
