A. 
Unless otherwise described by general law or this chapter, all duly constituted boards, agencies and committees shall meet during the month of January of each year and organize and thereafter shall meet not less than once each month.
B. 
The records of all boards, agencies and committees and other duly constituted bodies of the Township government of the Township of Marlboro shall be kept and maintained in the Administrative Offices of the Township government at a place designated by the Business Administrator and shall be subject to inspection and examination during normal business hours of the Township government as provided hereinabove and to the extent permitted by law.
C. 
Disqualification. In the event that any member of any board or agency, after being duly sworn and qualified for office, shall absent himself without explanation from 2/3 of the regularly scheduled meetings of said board or agency during any period of six months' duration, he shall forthwith be disqualified from said office. Upon certification from the secretary of said board or agency of such absence delivered to the Mayor, the Mayor shall declare said office vacant, and it shall thereupon be filled in the manner provided by law.
There shall be a Zoning Board of Adjustment, which shall be appointed pursuant to and shall have such powers as are provided by N.J.S.A. 40:55D-1 et seq. and by § 220-8 of Chapter 220, Land Use and Development, of the Code of the Township of Marlboro.
There shall be a Planning Board for the Township of Marlboro, which shall be appointed pursuant to and shall have such powers as are provided by N.J.S.A. 40:55D-1 et seq. and by § 220-9 of Chapter 220, Land Use and Development, of the Code of the Township of Marlboro.
There shall be a Marlboro Township Utilities Authority, which shall be constituted as provided in Chapter 60, Utilities Authority, of the Code of the Township of Marlboro.[1]

There shall be a Free Public Library governed by a Board of Trustees, which shall consist of the Mayor, the Superintendent of Schools and five citizens to be appointed by the Mayor with the advice and consent of the Council, for staggered terms of five years, at least four of whom shall be residents of the municipality. Vacancies shall be filled for the unexpired term. The Board of Trustees shall have all the powers and exercise all of the functions conferred on such bodies by the laws of the State of New Jersey (N.J.S.A. 40:54-1 et seq.).
There shall be a Historic Preservation Advisory Commission, which shall be appointed pursuant to and shall have such powers as are provided by N.J.S.A. 40:55D-107 et seq. and Article IX, Historic Preservation, of Chapter 220, Land Use and Development, of the Code of the Township of Marlboro.
There shall be an Environmental Commission, which shall be appointed pursuant to and shall have such powers as are provided by N.J.S.A. 40:56A-1 et seq. and Chapter 10, Boards, Committees and Commissions, Art. I, Environmental Commission, of the Code of the Township of Marlboro.
There shall be a Shade Tree Committee, which shall be appointed pursuant to and shall have such powers as are provided by Chapter 337, Trees, Art. I, Administration; Establishment of Shade Tree Committee; Conservation Officer, of the Code of the Township of Marlboro.
There shall be an Farmland, Historic and Open Space Committee, which shall be appointed pursuant to and shall have such powers as are provided by Chapter 30, Farmland, Open Space and Historic Sites, Art. I, Farmland, Historic and Open Space Committee, of the Code of the Township of Marlboro.
There shall be an Agriculture Advisory Committee, which shall be appointed pursuant to and shall have such powers as are provided by Chapter 30, Farmland, Open Space and Historic Sites, Art. III, Agriculture Advisory Committee, of the Code of the Township of Marlboro.

A. 
Establishment of the Youth Exchange Advisory Committee. The Youth Exchange Advisory Committee of the Township of Marlboro is hereby established as a special committee of the Township Council and shall be funded accordingly.
B. 
Purpose. The Youth Exchange Advisory Committee shall undertake the administration, management and planning of the Youth Exchange Program between the Township of Marlboro and the Nanto City, Toyama Prefecture, Japan, Wujiang, China and other cities or regions designated by the Mayor and Township Council.
C. 
Membership; organization; terms.
(1) 
The Youth Exchange Advisory Committee shall consist of up to but not more than 14 members appointed by the Township Council.
(2) 
The members of the Youth Exchange Advisory Committee shall include the Mayor, or his designee, who shall be a permanent member of the Youth Exchange Advisory Committee during the term of the Mayor's office.
(3) 
The members of the Youth Exchange Advisory Committee shall serve without compensation.
(4) 
The Township Council shall designate one of the members to serve as Chair and presiding officer of the Youth Exchange Advisory Committee. The Chair shall serve for a term of one year.
(5) 
The terms of office of the first Youth Exchange Advisory Committee members shall be for one, two and three years, as designated by the Township Council in making said appointments. Thereafter, the members' successors shall be appointed for terms of three years and until the appointment and qualification of their successors. The first members of the Youth Exchange Advisory Committee shall be appointed for the following terms:
(a) 
Three members for the term expiring December 31, 2013.
(b) 
Four members for the term expiring December 31, 2014.
(c) 
Four members for the term expiring December 31, 2015.
(d) 
Three members for the term expiring December 31, 2016.
(6) 
A vacancy in the Youth Exchange Advisory Committee occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as an original appointment.
(7) 
A quorum of the Youth Exchange Advisory Committee shall consist of a majority of the duly appointed and qualified members.
D. 
Duties. The Youth Exchange Advisory Committee is established to administer, plan and manage the Youth Exchange Program established by the sister agreement with the Town of Nanto City in Japan, Wujiang, China and other cities or regions designated by the Mayor and Township Council. A subcommittee will be formed for each sister city whose focus will be exclusively the planning and execution of the exchange of students with that sister city. The Youth Exchange Advisory Committee will be responsible for the oversight and coordination of rules, funding and joint activities of the subcommittees.
E. 
Limitations. The Youth Exchange Advisory Committee shall be a strictly advisory body with no power to regulate or promulgate rules and regulations. The Youth Exchange Advisory Committee members shall report to the Township Council on a regular basis regarding its activities.

There shall be an Affordable Housing Agency, which shall be appointed pursuant to and shall have such powers as are provided by Chapter 70, Affordable Housing, of the Code of the Township of Marlboro.
A. 
Ethics Board established. There is hereby established the Marlboro Township Ethics Board, consisting of six members who are residents of the Township, at least two of whom shall be public members. The members of the Board shall be appointed by the Mayor with the advice and consent of the Township Council. The members shall be chosen by virtue of their known and consistent reputation for integrity and their knowledge of local government affairs. No more than three members of the Board shall be of the same political party.
(1) 
The Board shall annually elect a Chairperson from among its membership.
(2) 
The members shall serve for terms of five years, except that, of the members initially appointed, two of the public members shall be appointed to serve for terms of five years, one member shall be appointed to service for a term of four years, and the remaining members shall be appointed to serve a term of three years. Each member shall serve until his or her successor has been appointed and qualified. Any vacancy occurring in the membership of the Board shall be filled in the same manner as the original appointment for the unexpired term.
(3) 
Members of the Board shall serve without compensation but shall be reimbursed for necessary expenses incurred in the performance of their duties.
B. 
Facilities and staff. The Business Administrator shall provide the Marlboro Township Ethics Board with the facilities needed for the conduct of its business and the preservation of its records and shall provide equipment and supplies as may be necessary and as may be provided for in the annual municipal budget.
(1) 
All necessary expenses incurred by the Marlboro Township Ethics Board and its members shall be paid, upon certification of the chairperson of the Board, by the Township Chief Financial Officer within the limits of funds appropriated in the annual budget or by emergency appropriations for those purposes.
(2) 
The Marlboro Township Ethics Board may request and receive assistance from the Township officers and employees, including the Municipal Clerk and the Municipal Attorney, and may appoint employees, including clerical staff, as are necessary to carry out the provisions of this Code, within the limits of funds appropriated by the Township Council for those purposes in the annual budget.
C. 
Powers. The Marlboro Township Ethics Board shall have the following powers:
(1) 
To adopt a Code of Ethics for the Township of Marlboro pursuant N.J.S.A. 40A:9-22.21 of the Local Government Ethics Law, N.J.S.A. 40A:9-22.1 et seq., which when effective shall be applicable to all officers and employees serving the Township in accordance with said law.
(2) 
To initiate, receive, hear and review complaints and hold hearings with regard to possible violations of the Code of Ethics or financial disclosure requirements by local government officers or employees serving the Township.
(3) 
To issue subpoenas for the production of documents and attendance of witnesses with respect to its investigation of any complaint or to the holding of a hearing.
(4) 
To forward to the County Prosecutor or the Attorney General or other governmental body any information concerning violations of the Code of Ethics or financial disclosure requirements by officers or employees serving the Township which may warrant the institution of other legal proceedings by the Attorney General.
(5) 
To render advisory opinions to local officers or employees serving the Township as to whether a given set of facts and circumstances would constitute a violation of any provision of the Code of Ethics or financial disclosure requirements.
(6) 
To enforce the provisions of the Code of Ethics and financial disclosure requirements with regard to officers or employees serving the Township and to impose penalties for the violation thereof as are authorized by the Code of Ethics.
(7) 
To adopt rules and regulations and to do other things as are necessary to implement the purposes of the Code of Ethics.
(8) 
To exercise such other powers as are given to it by the Local Government Ethics Law, N.J.S.A. 40A:9-22.1 et seq.
