No person or persons or corporation shall engage
in the business of yard/lot/facility maintenance, collecting or transporting
solid waste (garbage, refuse or recyclables) in the Township of Marlboro
without first obtaining a valid and current license to do so from
the New Jersey Department of Environmental Protection in accordance
with applicable state law and administrative regulations promulgated
pursuant thereto, including but not limited to N.J.S.A. 48:13A-7.1
et seq. and N.J.A.C. 7:26-2.8 et seq. A copy of said license must
be filed on July 1 of each year with the Board of Health.
Every person or persons or corporation who shall
transport any of the above through or along any street in said Township
shall use a vehicle properly constructed and furnished with a sufficient
covering so as to prevent the escape of the contents thereof.
Unless otherwise required by state law and regulations:
A. Vehicles used for the purpose of collection and transport
of solid waste materials shall be loaded in a manner that will prevent
any of the contents from spilling, falling or leaking from the vehicle.
Each vehicle used for garbage shall be provided with adequate and
sufficiently tight covering so as to prevent the escape of contents
thereof.
B. No such vehicles shall stand in the streets or other
public places at any time except when being loaded. Vehicles shall
also be in compliance with appropriate noise level and abatement requirements
and standards. It is further provided herein that solid waste collection
vehicles may operate from 6:00 a.m. to 6:00 p.m., Monday through Friday,
and 7:00 a.m. to 6:00 p.m. on Saturday.

C. It shall be unlawful for any vehicle to be driven,
moved, stopped or parked on any highway unless such vehicle is constructed
or loaded as to prevent any of its load from dropping, sifting, leaking
or otherwise escaping therefrom. Any person operating a vehicle from
which any liquid, materials or objects have fallen or escaped, which
could cause an obstruction, damage to a vehicle or otherwise endanger
travelers on public property, shall immediately cause public property
to be cleaned of all liquids, materials or objects and the vehicle
owner shall pay the costs of cleanup therefor.

All licensed solid waste haulers servicing residential,
commercial and/or institutional premises located within the boundaries
of the Township of Marlboro shall be required to complete and submit
tonnage reports of solid waste types collected within said boundaries,
excluding recyclables, on a quarterly basis to the Department of Public
Works of said Township. In lieu of this requirement, licensed haulers
may file with the Department of Public Works copies of such reports
as are required to be filed with the DEP by state law or regulation.
