Whenever the requirements of these regulations are at variance with
the requirements of any other lawfully adopted rules, regulations or ordinances,
the more restrictive of that imposing the higher standards shall govern.
A.
No public town street utility or improvement shall be
constructed in any street until it has become a public interest.
B.
Subject to the discretion of the Town Board, a subsurface
utility or improvement operated for revenue by the town or by a special district
may be constructed in a private street, provided that a public easement satisfactory
to the Town Board is obtained for such utility or improvement.
These regulations shall be enforced by the Town Planning Board. No building
permit or certificate of occupancy shall be issued by the Building Inspector
except where all the provisions of these regulations have been complied with.
A.
No permit for the erection of any building shall be issued
unless a street giving access to such proposed structure is an existing street
or unless such street appears on a recorded plat approved by the Planning
Board.
B.
No permit shall be issued unless and until such street
is fully completed in accordance with the street improvement plan, with the
exception that the final pavement (top coat) need not be applied. A performance
bond shall be required for the completion of surfacing of all roads. Alternatively,
no permit shall be issued unless and until a performance bond has been filed
assuring the completion of all road improvements in accordance with the street
improvement plan.
C.
No permit shall be issued except in accordance with an
approved land development plan.
