The provisions of this article shall apply except
when it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a police officer or
official traffic control device.
Wherever a space shall be marked off for the
parking of an individual vehicle on any street, highway, public parking
lot or private parking lot that is open to the general public, every
vehicle there parked shall be parked within the lines or markings
bounding such space.
The parking of vehicles is hereby prohibited at all times in those streets or parts of streets described in Schedule XIII (§
95-48).
The stopping of vehicles is hereby prohibited in those streets or parts of streets described in Schedule XIV (§
95-49).
The standing of vehicles is hereby prohibited in those streets or parts of streets described in Schedule XV (§
95-50).
The parking of vehicles is hereby prohibited in those streets or parts of streets described in Schedule XVI (§
95-51) during the hours indicated.

The parking of vehicles is prohibited on all
Town and county highways within the Town of Tuxedo between the hours
of 7:00 p.m. and 7:00 a.m. from October 1 to April 1 in each year.
The parking of vehicles is hereby prohibited in those streets or parts of streets for a longer period of time than that specified during the hours indicated in Schedule XVII (§
95-52).
The standing or parking of vehicles, except for the express purpose of loading or unloading of merchandise and goods, is hereby prohibited in the locations designated in Schedule XVIII (§
95-53).
No person shall park a vehicle upon any of the street or parts of streets described in Schedule XIX (§
95-54) except at the angle designated and only within the painted white stall lines.
The locations described in Schedule XX (§
95-55) are hereby designated as bus stops, and the parking or standing of vehicles other than buses is hereby prohibited in such locations.
The locations described in Schedule XXI (§
95-56) are hereby designated as taxi stands, and the parking or standing of vehicles other than taxis is hereby prohibited in such locations. Taxis using such stands shall not be left unattended and shall be subject to all other vehicle and traffic regulations of the Town.
The stopping, standing or parking of vehicles
is hereby prohibited in the parking spaces marked and designated as
"Fire Department Parking Only" in the parking lot of the Tuxedo Fire
District and in any designated fire zone.

A. Definitions. As used in this section, the following
terms shall have the meanings indicated:
PARKING METER ZONES
Such parts of municipal parking lots in the Town where, pursuant
to this chapter, parking meters or a central parking fee drop box
are installed, operated, maintained, policed and supervised and where
the payment of a fee for the privilege of parking, where such meters
or drop boxes are in operation, is fixed and required.
B. Municipal lot.
(1)
The municipally owned property described as
the "Daily-Fee Parking Lot on East Village Road" is hereby established
as a municipal parking lot meter zone where a central parking fee
drop box shall be installed, operated, maintained, policed and supervised.
(2)
This parking lot shall be used only by passenger
vehicles. Except as otherwise provided, no vehicle shall be parked,
put in place or left to remain or stand in any parking lot meter zone
so established, at any time on any day except Saturdays, Sundays and
national holidays, for the time limits prescribed therefor, except
upon payment of the required fee as shall be established from time
to time by resolution of the Town Board for a continuous period not
exceeding the number of hours prescribed for such parking lot meter
zone.
C. Parking fees. All fees for parking, including those
for yearly permits, shall be established from time to time by resolution
of the Town Board.
D. Yearly parking permits in parking lot meter zones.
Yearly parking tags may be obtained upon payment to the Police Department
of the required fee, for the privilege of parking a passenger vehicle
in any municipal parking lot meter zones. Such parking permit shall
not be transferable from one vehicle to another. The permit must be
prominently displayed near the windshield in the car so parked, so
that the license number of the vehicle written thereon by the issuing
official may be easily seen by the police officer.
E. Installation, maintenance, operation of parking meters
or drop box. The Highway Department is hereby authorized to install
a central parking fee drop box in all parking lot meter zones created
by this chapter. The Highway Department shall maintain, supervise
and police such central parking fee drop box to the end that the same
is kept in good workable condition. Each said central parking fee
drop box shall contain payment slots, numbered to correspond to each
parking space, for the deposit of coins and/or currency of the United
States of America therein for the period of time conforming to the
parking limit established therefor. A Town-appointed parking lot attendant
shall inspect the slots to verify payment and determine whether the
legal parking period has expired.
F. Marking of parking meter zones. The Highway Department,
or such officers or employees that it may designate, shall place numbered
signs and paint lines or marks on the curb or on the street or ground
alongside of or in front of each space to designate the parking meter
space for which said central parking fee drop box is to be used.
G. Manner of parking; parking to be within lines. A vehicle
parked in a parking space in a parking lot meter zone shall be parked
with the hood of such vehicle facing the parking meter or numbered
sign in front of such parking space and within the lines marked on
the ground for such parking space.
H. Use of parking meter space; payment of parking fee.
When any vehicle shall be parked or left to remain in any space alongside
of or next to which there is located a parking meter or numbered sign,
the operator of said vehicle shall, upon entering the parking space,
immediately deposit coins and/or currency of the United States of
America in the parking meter or central parking fee drop box slot
assigned to said parking space. Said parking space may then be used
by such vehicle for the period of time provided. It shall be unlawful
for any vehicle to be left or remain at any such parking space beyond
the limit fixed therefor.
I. Illegal parking. It shall be unlawful and an offense
for any person to permit a vehicle to remain in any parking space
beyond the period of time set or fixed for such parking space unless
the vehicle displays a valid yearly parking permit.
J. Use of slugs; tampering with meters. It shall be unlawful
and an offense for any person to deposit or cause to be deposited
in a parking meter or central parking fee drop box any slug, device
or substitute for a coin of the United States of America. It shall
be unlawful and an offense for any person to deface, injure, tamper
with, willfully break, destroy or impair the usefulness of any parking
meter or central parking fee drop box installed pursuant to this article.
No person, unless authorized by the Town Board, shall in any manner
open or attempt to open any parking meter or central parking fee drop
box.
K. Purposes of parking meter fees.
(1)
The coins and/or currency required to be deposited
in parking meters or central parking fee drop boxes as provided herein
are hereby levied and assessed as fees to provide for the cost of
supervision, regulation, installation, operation and maintenance of
the parking meters or central parking fee drop box and also for the
cost of construction, supervision, regulation and maintenance of parking
lots and for the enforcement of the provisions of this article.
(2)
The coins and/or currency required to be deposited
shall be paid to and become the property of the Town of Tuxedo.
L. Collection of parking fees. The Supervisor shall designate
an officer or employee of the Town to make regular collections of
the money deposited in the parking meters or central parking fee drop
box. The officer or employee, upon making such collections, shall
immediately deliver all coins and/or currency deposited in the parking
meters or central parking fee drop box to the Supervisor, who shall
count and deposit, or cause to be counted and deposited, such funds
in one of the official bank accounts of the Town.
M. Free parking spaces. Nothing in this article shall
be construed as prohibiting the Town from providing for free parking
spaces for community groups and for other purposes of similar nature.
N. Violations and penalties. Any person who shall violate
any provisions of said article relating to the parking of vehicles
shall, for a first conviction thereof, be punished by a fine of not
more than $50 or by imprisonment for not more than 15 days, or by
both such fine and imprisonment; for a second such conviction within
18 months thereafter, such person shall be punished by a fine of not
more than $100 or by imprisonment for not more than 45 days, or by
both such fine and imprisonment; upon a third or subsequent conviction
within 18 months after the first conviction, such person shall be
punished by a fine of not more than $250 or by imprisonment for not
more than 90 days, or by both such fine and imprisonment in the discretion
of the court. All fines collected as a result of the above schedule
shall remain the property of the Town of Tuxedo.
O. Removal of vehicle by Town for nonpayment of parking
tickets.
(1)
Any police officer is hereby authorized to remove
or cause to be removed to the nearest place of impoundment any vehicle
parked illegally in any Town parking lot or public place where report
has been made that six or more delinquent parking tickets have been
issued to an individual, corporation or governmental body in whose
name such vehicle or vehicles are registered, for violation of any
Town of Tuxedo parking law or regulation.
(2)
The owner or other person lawfully entitled
to the possession of such vehicle may be charged with a reasonable
cost for removal and storage as well as payment of delinquent tickets
before the vehicle is released.
P. Recovery of costs pursuant to Subsection
O. Any person claiming a vehicle which has been removed pursuant to Subsection
O for nonpayment of six or more parking tickets shall be required to pay the Town an administrative fee of $100, together with $65 for the cost of removal, and storage charges on said vehicle at the rate of $35 per day for outdoor storage, $45 per day for storage inside a fence or $50 per day for indoor storage.
The stopping, standing or parking of vehicles
is hereby prohibited in the areas marked and designated by the Highway
Superintendent as an emergency access road.
