A clean, wholesome and attractive environment is declared to be of importance to the health and safety of the inhabitants of the Town of Wawayanda and of the general public. In addition, such environment is deemed essential to the maintenance and continued development of the economy of the Town and the general welfare of its citizens. It is further declared that the operation of solid waste management facilities and the collection and transport of solid waste by transporters and carters are activities which may endanger the health, safety and welfare of the public, the Town and the environment, and those activities need to be regulated for the public's protection and to protect the environment. Chapter 152 originally was adopted to regulate solid waste management facilities and transporters and carters of solid wastes. The Town Board of the Town of Wawayanda hereby finds that the existing provisions of Chapter 152 require replacement to reflect practices and standards consistent with current New York State law and regulations and to insure the continued protection of the health, safety and welfare of the public, the Town and the environment while at the same time providing an opportunity for the conduct of the referenced activities when not in conflict with the express purposes and protections of this chapter.
