These rules and regulations shall be known and may be cited as the "Town of Williamson Subdivision of Land Regulations."
By authority of resolution of the Town Board of the Town of Williamson adopted on January 12, 1965, and as amended, pursuant to the provisions of the Town Law §§ 271 through 284, the Planning Board of the Town of Williamson is vested with the power and authority to approve plats and streets for subdivisions within the incorporated area of the town. Such approval, in accordance with the procedures and regulations set forth below, is prerequisite to recording of all plats of any subdivision of land in the office of the Wayne County Clerk and the issuance of a building permit for land subject to these subdivision regulations.
To carry out the purpose of the Town Law and the Town Board in providing for plan approval, these minimum rules and regulations are adopted by the Planning Board and approved by the Town Board to provide for the future growth and development of the town and to afford adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and welfare of its population. Consistent with such purposes, these rules and regulations will assure the orderly development of residential areas, the coordination of existing streets, public utilities with new service, the proper provision of open spaces for passive and active recreation and the proper location of future sites for public buildings and shopping areas, all to the mutual benefit of the town and its residents.
The following words set forth in the subdivision regulations herein shall be defined as follows:
BOARD
The Planning Board of the Town of Williamson.
CONCEPT PLAN
The first plan for a development which outlines the development scope and addresses the requirements for plan submittal.
EASEMENT
A right granted to use certain land for a special purpose not inconsistent with the general property rights of the owner.
FINAL PLAN
The final map, drawing or chart in which the subdivider's plan of subdivision is presented to the Board for consideration for final approval in accordance with § 152-11.
LOT
A parcel of land intended for transfer of ownership or building development that is presently occupied or capable of being occupied by one principal building or use and by those buildings or uses accessory to the principal building or use.
MASTER PLAN
The Official Map and the Town Plan as adopted by the Planning Board, pursuant to the authority granted to it and the applicable provisions of the Town Law, setting forth the streets, highways and parks established or proposed with all changes and additions that may be approved by the Town Board.
PLAT
The approved final plan, with proper signatures and recorded with the Wayne County Clerk.
PRELIMINARY PLAN
A plan showing existing features of the land and proposed layout of all lands to be subdivided for use at preliminary review in accordance with § 152-9.
RIGHT-OF-WAY
Lane opened for public use as a street, alley or pedestrianway, which may or may not be dedicated to public use.
SUBDIVISION
A division of any part, parcel or area of land, whether by lots or by metes and bounds, into lots or parcels for the purpose of conveyance, transfer, improvement or sale.
A. 
MINOR SUBDIVISIONA subdivision of not more than five lots on an existing street, with each proposed lot complying with Chapter 178, Zoning, and requiring no new streets nor the creation or extension of improvement districts for the supply of water, sewer or drainage utilities and having no substantial adverse effect on access to, use or development of the remainder of the parcel or adjoining parcels.
B. 
MAJOR SUBDIVISIONAny subdivision not classified as a minor subdivision.
C. 
RESUBDIVISIONA revision of all or part of an existing filed plat.
TOWN ENGINEER
The duly designated Engineer of the Town of Williamson or, if there is no such designee, the engineer to the Planning Board. At the discretion of the Planning Board, the Engineer shall be responsible to review the project plans and make recommendations to ensure that the best interests of the town shall be preserved.
