The chapter shall be known and cited as the "Electrical Code of the
Village of Williston Park."
All matters concerning, affecting or relating to the installation, alteration
or removal of electrical wiring and equipment are presumptively provided for
in this chapter, except insofar as such provisions are contained in the Village
Law, the Labor Law, the State Uniform Fire Prevention and Building Code or
the rules promulgated in accordance with the provisions of this chapter by
the Village Board of Public Safety.
This chapter is hereby declared to be remedial and shall be construed
liberally to secure the beneficial interests and purposes thereof.
No electrical wiring or equipment of any building, structure or premises,
so far as provided for in this chapter, shall be constructed or altered in
the Village of Williston Park except in conformity with the provisions of
this chapter. No building already erected or hereafter to be built in the
village shall be altered in any manner that would be in violation of any of
the provisions of this chapter or any rule of the Village Board of Public
Safety made and issued thereunder.
A.
All electrical wiring and equipment in the village shall
be installed, altered or removed by or under the supervision of any employing
or master electrician holding a license issued by the licensing officer after
receiving a certificate of competency from the Examining Board of Electricians
in accordance with the provisions of this chapter or a master electrician's
license issued in accordance with the Electrical Code of the Town of North
Hempstead, except that an electrician or helper employed by the State of New
York or any political subdivision thereof or any electrician or helper employed
by any public utility company subject to the jurisdiction of the Public Service
Commission of the State of New York may install, remove or alter electric
wiring and equipment without a license, provided that such installation, removal
or alteration is performed in the employment by such public utility company
or the State of New York or any political subdivision thereof.
B.
Nothing contained herein shall preclude the installation
of replacement parts or units in existing oil or gas burners, heating systems
or air-conditioning and refrigeration units or prevent the owner of a residence
building occupied or to be occupied by the owner and family from installing,
removing or altering electrical wiring and equipment, provided that the work
is done in accordance with the provisions of this chapter.
C.
Before any work is commenced by a licensed electrician
of the Town of North Hempstead, such person will be required to register with
the Village Clerk, giving both the town license number and required insurance
data.

Unless otherwise expressly stated, the following terms
shall, for the purpose of this chapter, have the meanings herein indicated:
The certificate issued by the Examining Board of Electricians pursuant
to the provisions hereof.
The license issued by the village to a master or employing electrician.
A license issued by the village to an employee, owner, partner or
corporative officer of a commercial or industrial establishment located within
the village and permitting the licensed holder to engage in the installation,
alteration or repair of electrical wiring and equipment within the establishment's
building or buildings.
The license issued by the village to permit the holder thereof to
engage in the installation or alteration of electrical wiring and equipment
of a special and limited nature, including but not limited to outdoor advertising
signs, oil or gas burner installations, marine systems and gasoline service
stations.
All equipment utilizing electrical energy to supply light, heat or
power in or on buildings and shall include signal and control systems operating
at 25 or more volts or communications utilities using like voltages and, with
reference to repair activities, shall not include such small appliances as
toasters, broilers or fixtures commonly connected to existing lighting and
appliance circuits.
Any body of citizens who may be appointed by the Mayor for that purpose,
subject to approval by the Board of Trustees.
A person in the employ of or working under the supervision of a master
or employing electrician, as defined herein, who does the actual work of installing,
setting up or putting together electrical systems, wiring or equipment. It
shall not include apprentices or helpers who work in the presence of or under
the direct supervision of a journeyman electrician.
A person established in the electrical business as an individual,
member of a partnership or officer of a corporation and engaged, by contract
or otherwise, in the work of installing, setting up or putting together any
electrical system, wires or equipment and appurtenances of any kind in or
on buildings or premises.
A.
Appointment. An Examining Board of Electricians shall
be appointed by the Mayor subject to the approval of the Board of Trustees
in such number and for such term as the Board of Trustees shall determine.
B.
Chairperson. The Examining Board of Electricians shall
elect a Chairperson from its membership who shall retain voting rights identical
with that of the remainder of the Examining Board of Electricians.
C.
Meetings. The Examining Board of Electricians shall meet
at the discretion of the Board of Public Safety.
D.
Powers and duties.
(1)
The Examining Board of Electricians shall examine all
applicants for licenses as to qualifications, shall pass judgment on all licensing
matters brought to its attention, shall review all applications for renewal
of licenses and may make appropriate recommendations to the Board of Trustees
as to the issuance, modification, suspension or revocation of licenses or
renewals thereof upon which the Examining Board of Electricians has passed
judgment in the course of its official business. The Board may also make recommendations
as it deems necessary or proper to the Board of Trustees concerning proposed
additions, changes or other amendments to this chapter.
(2)
The Examining Board of Electricians shall keep a written
record of all its meetings and proceedings and recommendations to the Board
of Trustees.
(3)
The Examining Board of Electricians may make such rules
and regulations for the conduct of its business as may be necessary and proper.
A.
Persons applying for examination for a license to engage
in the electrical business shall, before being examined, file with the Board
of Public Safety an application on such form as may be prescribed by the Examining
Board of Electricians and shall furnish to the Examining Board of Electricians
such information as it may require concerning the applicant's fitness and
qualifications to receive a license as aforesaid. All applications shall be
under oath.
B.
Each applicant shall be required to furnish two vouchers,
who shall sign under oath on forms prescribed by the Examining Board of Electricians
certifying to the time the applicant has been employed by them as a journeyman
electrician or the period of time they have known such applicant as master
or employing electrician. Such vouchers, at the time of signing applications,
must be lawfully engaged in the electrical business.
C.
All applications shall expire and be canceled after a
period of one year from the date of the application if the applicant does
not appear for examination or re-examination within that period.
A.
Parts. The examination by the Examining Board of Electricians
shall be in two parts, namely, a practical test to determine the applicant's
skill and a written examination. The written examination shall consist of
questions designed to determine the applicant's fitness and qualifications
to engage in the business of master or employing electrician.
B.
English language. All examinations shall be written by
the applicant and must be in English.
C.
Time. Time of holding examination shall be left to the
discretion of the Examining Board of Electricians. Ample notice shall be given
to applicants.
D.
Certificate of competency. Persons who pass the test
as prescribed by the Examining Board of Electricians shall receive a certificate
of competency as evidence of eligibility for the class of license for which
such test is prescribed.
E.
Re-examination. An applicant who fails to attain a minimum
passing mark in the test shall not be eligible for another test until the
expiration of 30 days.
A.
No applicant shall be examined for a license unless the
applicant shall be 21 years of age, of good moral character and able to give
satisfactory evidence of experience as at least one of the following:
(1)
An employing electrical contractor who has had an established business for at least five years in the installation, alteration and repair of electrical wiring or equipment or whose experience as a journeyman electrician, as set forth in Subsection B, and as an employing contractor totals at least five years.
(2)
A journeyman electrician who has worked as a journeyman
for at least five years with his or her tools on installation, alteration
and repair of electrical wiring and equipment.
(3)
A graduate engineer of a college or university who holds
at least a bachelor of science degree and has in addition worked at least
one year with his or her tools on installation, alteration and repair of electrical
wiring and equipment.
B.
No applicant for a Class B license shall be examined
unless it is shown by satisfactory evidence that the applicant is a partner,
officer, chief electrician or other authorized representative of the firm
which is likely to or may supervise or perform the projected installation,
alteration or repair of electrical wiring and equipment.
C.
No applicant for a Class C license shall be examined
unless it is shown by satisfactory evidence that such person has had a minimum
of three years' experience in the special installations permitted under this
class of license.
A.
Issuance. Upon filing the certificate of competency for
the license sought, the payment of the required fees and complying with all
other provisions of this chapter, the licensing officer shall issue the appropriate
license.
B.
Expiration; renewal. All village licenses shall expire
on January 31 of each year. Applications for renewal of licenses shall be
filed during the month of January of each year with the Village Clerk, together
with such verification of the electrical work performed under the authority
of the prior license as the Board of Public Safety may require to determine
the continuing competency of the licensee. Such renewals shall not be for
a period longer than one year from February 1 of each year.
C.
Reapplication required for failure to renew. Any licensed
electrician not securing his or her renewal by the first of February of each
year shall be required to make a new application.

All electrical wiring or equipment installed, altered or removed in
or on buildings to which this chapter is applicable must be covered by an
application to the New York Board of Fire Underwriters, Electrical Inspectors,
Inc., or such other electrical inspection company approved by the Board of
Trustees, for the proposed electric work. Nothing herein contained shall be
construed to prohibit a homeowner from installing his or her own electrical
work, provided that such homeowner shall file with the Board of Public Safety
an affidavit evidencing that such work is to be performed by the homeowner
and a copy of such affidavit is accompanied by the application for such work
to the electrical inspection company.

The electrical wiring and equipment installed, altered or removed pursuant
to this chapter shall be in strict conformity with the provisions hereof,
the State Uniform Fire Prevention and Building Code and the statutes of the
State of New York, as well as all other provisions of this Municipal Code
and all applicable rules and regulations of the village, state and county.
A.
Loaning of license. No person shall lend, rent, transfer
or assign his or her license to any other person, nor shall any person make
use of a license which is not his or her own.
B.
Use of title. No person not having been issued a Class
A license as defined herein shall represent himself or herself as a master
electrician or licensed electrical contractor on signs, stationery or vehicles,
in advertising or in any other manner for the purpose of pursuing such business
in the village.
C.
Restriction on use of Class B license. A Class B license,
as defined herein, shall be valid only as it pertains to work performed within
the property limits of the firm to which it is issued.
D.
Multiple use of license prohibited. No person holding
a license issued under the provisions of this chapter shall permit or authorize
the use of such license by more than one firm, partnership, company or corporation,
and the holder thereof must be an employee, partner, member or stockholder
of such firm, partnership, company or corporation performing the electrical
work under the authority of such license.
The Chief Inspector and each of the duly appointed inspectors of the
New York Board of Fire Underwriters are hereby authorized and deputized as
agents of the village, for the purposes of this chapter only, to make inspections
and reinspections of all electrical work authorized by permits issued by the
village pursuant to this chapter and to approve or disapprove the same. There
shall be no cost for inspections or reinspections that are requested by a
village official in the performance of his or her duties. The cost of a regular
inspection or an inspection for the purpose of removing violations that could
have been brought about by a reinspection shall be borne by the licensed electrician
requesting inspection by application, and the charge for the same shall be
based on the current fee schedule of the New York Board of Fire Underwriters,
which shall be filed in the office of the Village Clerk.
Prior to performing any electrical work in the Village of Williston
Park, the licensee must file the following certificates of insurance:
A.
A comprehensive insurance policy in the amounts of $100,000/$300,000
bodily injury and $25,000 property damage indemnifying the village of and
from all damages or claims for damage to public or private property or to
any person arising from unlawful or negligent acts or omissions of said master
electrician, his or her agents or employees or anyone acting under the authority
of his or her license in installing, constructing, altering or repairing electrical
wiring or equipment. The village shall be notified, in writing, 30 days in
advance of any material modification or cancellation of this policy and the
certificate filed shall so state.
B.
A certificate of insurance showing compliance with the
Workers Compensation Law on a standard form approved by the New York State
Department of Labor or, in lieu thereof, an affidavit certifying to the fact
that the licensee has no employees.
C.
A certificate of insurance showing compliance with the
New York State Disability Benefits Law on Form No. 120.0 approved by the New
York State Department of Labor or, in lieu thereof, an affidavit certifying
to the fact that the licensee has no employees.

The Board of Trustees, on its own initiative or on the recommendation
of the Board of Public Safety, may revoke a village license or the registration
privilege granted a town licensee or suspend such license or registration
for a period of not more than 60 days where it has been determined that a
licensee has submitted a false application or made false statements in obtaining
such license or registration or any renewal thereof or has repeatedly failed
to perform the work engaged in under the authority of such license in a competent
and satisfactory manner or has violated the restrictions in the use of such
license as set forth in this chapter. When such action is taken concerning
town licenses the Town Board of Electrical Examiners shall be notified.
This chapter shall not be construed to relieve from or lessen the responsibility
of any person owning, operating, controlling or installing any electrical
wiring, devices, appliances or equipment for loss of life or damage to person
or property caused by any defect therein, nor shall the village be deemed
to have assumed any such liability by reason of any license issued pursuant
to this chapter.
