It shall be unlawful for persons to assemble in any street or on any
sidewalk, crosswalk, alley or street in the village or to suffer or to cause
such assemblage or to take part in, conduct, suffer or cause any parade or
demonstration in any village street, highway, sidewalk, alley or street corner
except as herein provided.
A.
Streets, sidewalks and highways of the village may be
used for the purpose of public assembly or parades by permit issued by the
Board of Trustees of the village upon application made to the Village Clerk.
Such application shall be made in writing and shall state:
(1)
The name, address and telephone number of the person
seeking to conduct such parade or assembly.
(2)
If the parade or assembly is to be conducted for, on
behalf of or by an organization, the name, principal address and telephone
number of the organization.
(3)
The name, address and telephone number of the person
or officer of an organization authorized to be responsible for the good order
and conduct of the parade or assembly.
(4)
The date when the parade or assembly shall be conducted.
(5)
The time when the parade or assembly will commence and
terminate.
(6)
The place of the assembly or, if a parade, the route
to be traveled, the starting point, the termination point and the assembly
area.
(7)
The approximate number of persons and vehicles which
will constitute such parade or assembly.
B.
The Board of Trustees may limit or regulate the time
and place at which such parades or public assemblages shall be permitted to
be held and make any reasonable regulations in respect thereto.
C.
No permit shall be granted where there is good reason
to believe that the proposed assembly, procession or parade will be disorderly
in character or tend to disturb the public peace.
D.
Each permit shall designate specifically the route through
which the procession or parade will move or the place where the assembly will
be held, and it will also specify the width of the roadway to be used and
may include such rules and regulations as the Board of Trustees may deem necessary.
E.
The chief officer of any parade, procession or assembly
shall be responsible for the strict observance of all rules and regulations
included in said permit.
F.
Applications for such a permit shall be made at least
seven days prior to the proposed date of the parade, procession or assembly,
but the Village Board may waive the time limitation where good cause is shown.
The provisions of this chapter shall not apply to:
A.
Processions or parades when all persons taking part therein
are police officers, fire fighters, members of the Armed Forces of the United
States or the State New York or officials of governmental units.
B.
Processions, parades or assemblies declared by resolution
of the Board of Trustees to be a part of official village ceremonies.
C.
Students going to and from school classes or participating
in school activities, provided that such conduct is under the immediate direction
and supervision of the proper school authorities.
Every person participating in any assembly, procession or parade or using the streets or sidewalks for public assemblage without a permit or any person participating in any parade, procession or public assemblage who shall fail to comply with the conditions and restrictions contained in the permit or shall conduct or permit the same to be conducted in a disorderly manner shall be guilty of a violation punishable as provided in Chapter 1, §§ 1-18 and 1-19 of this Code.
