A person desiring to conduct the trade, business
or calling of a plumber or of plumbing in the village as an employing
or master plumber shall be required to obtain a master plumber's license
issued by the Board of Public Safety.
A.
Required. Any person desiring to obtain a master plumber's
license shall be required to submit to an examination before a Plumbing
Board, except as herein provided for, and shall be examined as to
his or her experience and qualifications for such trade, business
or calling, and if the Board of Public Safety finds such person to
be competent, it shall issue to the person applying a certificate
of competency, which shall be filed with the Board of Trustees before
the issuance of the master plumber's license.
B.
Experience. No person shall be examined unless he
or she shall have had experience of at least five years as a journeyman
plumber and is able to furnish satisfactory evidence of such fact.
No application will be reviewed from any person who is not a citizen
of the United States.
C.
Exception. Anything contained in this chapter to the
contrary notwithstanding, any person who holds a valid certificate
of competency or license to conduct the trade or business of an employing
or master plumber duly issued by any municipality which is a party
to a reciprocal licensing compact to which the Incorporated Village
of Williston Park is also a party shall be deemed to be competent
to conduct that business in the Incorporated Village of Williston
Park, New York, and shall not be required to obtain a certificate
of competency from the Board of Public Safety of the Incorporated
Village of Williston Park as a prerequisite to conducting that business
in the Incorporated Village of Williston Park, but he or she must
comply with and shall be subject to and bound by all other provisions
and requirements of this chapter and by all rules and regulations
adopted pursuant thereto.

The applicant for a certificate of competency shall pay a fee as provided in Chapter 93, Fees, which shall accompany the application to cover the cost of his or her examination, and no part of said fee shall be returned to the applicant if the certificate is not granted.
The Board of Public Safety shall, upon application
therefor, issue a master plumber's license to the person entitled
thereto in accordance with the preceding sections of this chapter,
and any person to whom the master plumber's license is issued shall
register his or her name and address at the office of the Village
Clerk.
Any master plumber's license issued under the
provisions of the preceding sections of this chapter shall expire
on the 31st day of December of the year in which it is issued and
may be renewed for one year from the first day of January in each
year upon application made within 30 days preceding expiration. The
master plumber's license of any person failing to renew within the
time above specified shall become absolutely void.
Any licensed plumber not securing his or her
renewal by the first of January of each year shall be required to
make a new application and pay the same fee as for issuance of a master
plumber's license.
The fee for the issuance of a master plumber's license and the fee for each renewal thereof shall be as provided in Chapter 93, Fees.
A.
Corporations. A domestic corporation desiring or intending to conduct the trade, business or calling of a plumber or of plumbing in the village as an employing or master plumber may do so, provided that one or more officers of such corporation separately or aggregately hold and own at least 51% of the issued and outstanding stock of such corporation and provided that each of such officers holding such percentage of the stock is the holder of a master plumber's license issued by the Board of Public Safety pursuant to § 161-8 of this chapter. Each and every officer and employee of said corporation shall comply with all the rules and regulations applicable to master or employing plumbers in the village. Such corporation shall register at the office of the Village Clerk as provided in § 161-8 of this chapter and file a certified copy of the certificate of incorporation as well as an affidavit showing the names of the principal stockholders and officers at the time of filing the application for a license and for each renewal thereafter.
B.
Partnerships. A partnership desiring or intending to conduct the trade or business or calling of a plumber or of plumbing in the village as an employing or master plumber may do so, provided that one or more partners holding a majority interest in the partnership are holders of a master plumber's license issued by the Board of Public Safety pursuant to § 161-8 of this chapter. Each and every partner and employee of such partnership shall comply with all the rules and regulations applicable to master or employing plumbers in the village. Such partnership shall register at the office of the Village Clerk as provided in § 161-8 of this chapter and file a certified copy of the partnership agreement at the time of filing the application for a license and for each renewal thereafter.
A.
No person, corporation or copartnership licensed as
a master plumber pursuant to this chapter shall apply for, receive
or make use of any permit granted by reason of such license so as
to permit the performance of any plumbing work not done by the person,
corporation or copartnership or under his, her or its immediate supervision.
B.
Any licensed master plumber shall submit, on request
of the Plumbing Inspector, evidence reasonably satisfactory to such
Plumbing Inspector that he or she has not permitted any such work
to be done in his or her name, other than by a licensed plumber, and
that he or she has fully complied with the requirements of this section.
A.
Bond. Any master plumber shall file with the Board
of Trustees, before beginning operations under his or her license
and upon each renewal of said license, a surety company bond approved
by the Board in the penal sum of $4,000 indemnifying and making harmless
the Village of Williston Park of and from all damages or claims for
damage to a public sewer, to water service mains or pipes, to a highway
or the surface thereof or to public or private property of any person
arising from the unlawful or negligent acts or omissions of said master
plumber, his or her agents or employees or anyone operating under
the authority of his or her license in making connections with the
public sewer; in opening a public sewer or in making an opening or
excavation in a public highway, public square or public park; in maintaining,
guarding, refilling or working in or about such openings or excavations;
or in maintaining or guarding objects and materials taken from such
opening or excavation or used in connection therewith. The bond shall
remain in full force and effect for the calendar year in which it
is issued, unless sooner canceled by the Plumbing Board. It shall
be and remain security for indemnity for damages as aforesaid during
the time it is enforced.

B.
Liability insurance. Before any permit is issued a
certificate of public liability insurance of not less than $100,000
per person and $300,000 per accident for personal injury and $50,000
for property damage for each accident and $100,000 aggregate shall
be filed with the Incorporated Village of Williston Park, New York,
to cover the village as a named insured in the event of any injury
to persons or property. Said policy or a renewal thereof must be kept
in effect until the completion of all work under the above-mentioned
permit and the issuance of the certificate of compliance. In the event
that such policy shall expire or be canceled and no replacement is
furnished prior to such expiration or cancellation, the permit issued
will immediately be revoked.
C.
Workers' compensation insurance. Before any permit
is issued a certificate of the plumber's current workers' compensation
insurance policy must be filed with the Incorporated Village of Williston
Park, New York, as required by § 57 of the Workers' Compensation
Law. Said policy or renewal thereof must be kept in effect until the
completion of all work under the above-mentioned permit and the issuance
of the certificate of compliance. In the event that such policy shall
expire or be canceled and no replacement thereof is furnished prior
to such expiration or cancellation, the permit issued will immediately
be revoked.
