No person, firm or corporation shall open or
excavate in any Village street without a permit therefor. A nonrefundable
fee, in an amount set by resolution of the Board of Trustees,[1] shall be paid in cash, certified check or bank draft or
money order, payable to the Village of Yorkville, for each street
cut made to secure the permit.
A.
A cash deposit (including certified check or bank draft or money order) or bond in the amount of $500 for all cuts, except those streets in Subsection B, to be paid to the Village and held in escrow for a period of up to one year shall also be required.
B.
A cash deposit (including certified check or bank
draft or money order) or bond in the amount of $1,000 shall be paid
to the Village and held in escrow for a period of up to one year for
any street cuts in Whitesboro Street and Russell Avenue and Fairview
Avenue (certain locations).
If repairs to the streets are not done in a
proper manner and are not certified as being proper by the Village
Engineer or Village Highway Superintendent, then the Village, upon
giving written notice to the contractor, shall have the right to make
repairs and use the escrow money for said repairs.
The permit application shall include the proper
mailing address of the party securing the permit, and this address
shall be used by the Village for all correspondence to the party requesting
the permit.
