A.
A definite set amount of funds will be included in
each yearly budget to finance the Sidewalk Construction Program. Only
the amount budgeted each year will be expended on this program.
B.
Depending on the number of residents requesting to
participate in this program, the order of allotment of funds will
be determined each year. If the number of applicants exceeds the allotted
funds for that year, a lottery format will be used. This determination
will be left to the discretion of the Village Board each year.
This program will include only sidewalk construction;
that is, the replacement of sidewalks in place at the time that this
program goes into effect. Construction of new sidewalks; that is,
installing sidewalks where at this time no sidewalks exist, may be
undertaken at a later time. The Sidewalk Construction Program will
be amended at that time.
A.
A request shall be made to the Village, at which time
the Highway Superintendent will inspect the sidewalk to be replaced
and will make a determination as to the number of square feet of sidewalk
that need replacement.
B.
The homeowner and the Highway Superintendent must
agree on the number of square feet of sidewalk which will be replaced.
The Highway Superintendent will issue a set
of standard specifications of the Village of Yorkville and a permit
to the homeowner. The permit will be signed by the Highway Superintendent
and the homeowner. The homeowner will retain one copy of the permit.
The work may be done by a contractor or the
homeowner, as long as the specifications are met.
The Highway Superintendent will confirm the
measurements and will certify that the work has been done to his satisfaction.
All work must be done within 30 days of the
issuance of the permit. If not done within 30 days, the homeowner
will forfeit his permit.
A.
A Village of Yorkville claim must be filed within
30 days of completion of the replacement of the sidewalk.
B.
Only the specified Village of Yorkville claim will
be accepted for payment. This claim must be accompanied by the paid
invoice from the contractor or supplier of the material used. Signatures
of the contractor and the homeowner must be certified by a notary
public.
C.
This claim must also be certified by the Highway Superintendent
as to his satisfaction of the work done and the number of square feet
of replacement sidewalk authorized in the permit.

When all requirements are met, the homeowner
will be reimbursed at the rate of $3.50 per square foot for the construction
of replaced sidewalk.
A.
The period of construction in this program will be
from May 1 through September 30 of each year. No claims will be honored
for sidewalk replacement work done after September 30 of each year.
B.
Applications for this program may be submitted at
any time; however, the cutoff date for work to be done in the current
year's construction will be July 30 of each year.
Applications which may not be successful in
the lottery, if that is the case, or submitted too late for construction
to be done in the current year will be given preference the following
year.
