It shall be unlawful for the owner, lessee, tenant or occupant of any building within the limit of the borough or of any lot or premises to drain any water from conductors or downspouts from any building or from any such lots or premises upon any public sidewalks in the borough or to permit the same to be drained upon any such public sidewalk; provided, however, that where there are no public sewers into which the water from downspouts or conductors or from lots or premises may be drained, the water from such conductors or downspouts or lots or premises may be drained by means of pipes or drains under the sidewalks to the cartway of the street, avenue, lane or alley upon which such sidewalk or sidewalks may exist.
Any person who shall violate any provision hereof shall, upon conviction thereof, be sentenced to pay a fine of not more than six hundred dollars ($600.) and costs and, in default of payment, shall be subject to imprisonment for a term not to exceed thirty (30) days.
