For the purpose of this chapter, the following terms shall have the meaning indicated:
RECREATION PLACES
Includes all parks, playgrounds, swimming pools, pavilions, and recreation places now or hereafter owned or maintained by the Township of Lehigh, Pennsylvania, or operated by its Park and Recreation Commission.

The rules and regulations herein set forth shall apply to all said recreation places.
The said recreation places are for the benefit and pleasure of the residents of the Township of Lehigh, Pennsylvania, and all persons who use the said facilities shall be subject to the rules and regulations herein set forth and any amendments thereto.
No person shall commit any of the following acts within any of said recreation places:
A. 
Throwing or propelling stones or missiles of any kind; or[1]

B. 
Hitting or driving golf balls; or
C. 
Permitting animals of any kind to be within such recreation places, whether or not under control or leash; or
D. 
Throwing, depositing or draining any offensive or unwholesome substance or liquids of any kind or depositing or throwing any paper, fruit, food, refuse or lunch baskets within said recreation places, except in receptacles provided for that purpose; or[2]

E. 
Writing, painting, carving, or otherwise defacing or disfiguring any tree, bench or other structure; or[3]

F. 
Operating a licensed motorized vehicle on other than the paved roadways or parking areas of said recreation places; or
G. 
Operating an unlicensed motorized vehicle; or
H. 
Operating a licensed motorized vehicle on the paved roadways or parking areas of said recreation places at a speed in excess of 10 miles per hour; or
I. 
Obstructing, in any way, either totally or partially, any of the paths or roadways in said recreation places; or
J. 
Picking or carrying any flowers, shrubs or trees that are growing or located in the recreation places; or
K. 
Carrying any ax, saw, picks, shovels, hoes or spades; or
L. 
Posting or displaying any sign, banner, or advertisement of a political or commercial nature; or
M. 
Building, starting or lighting any fires except at those places or structures provided therefor; or
N. 
Injuring or destroying any wildlife; or
O. 
Playing baseball, tennis, football or any other game or sport at a place not designated for that purpose; or
P. 
Violating any regulations relating to the use of any building or place; or
Q. 
Defacing, writing upon, or mutilating any notice posted within the recreation places by order of Lehigh Township officials; or
R. 
Entering or leaving any recreation place by motor vehicle except at the established and designated ways of entrance and exit; or
S. 
Pulling, injuring or breaking any flowers, fruits, plants, trees, grass, shrubs, turf, and pump or water fixtures or any other structure.
A. 
The recreation places shall be open to the public between the hours of 9:00 a.m.to 11:00 p.m., prevailing time, each day, provided, however, that any sound amplification shall cease at 10:00 p.m. each evening.
B. 
Any person or persons found within said recreation places when same are closed as provided in this chapter shall be guilty of violating this chapter.

Anyone or any group desiring to use the pavilion facilities of any of the recreation places shall, by written application, secure a permit from the Township in advance and shall pay the established fee and security deposit.

A. 
Upon proper written application on the form provided by the Township, the Township may issue a permit permitting the consumption of alcoholic beverages at Danielsville Park, Delps Park or Indiantrail Park, said consumption to be in accordance with all applicable Commonwealth of Pennsylvania laws and regulations. In order to consume alcoholic beverages at Danielsville Park, Delps Park or Indiantrail Park, the permit issued by the Township must clearly indicate permission has been granted.
B. 
Alcoholic beverages may not be consumed at any other Township recreation place, and alcoholic beverages may not be sold at any Township recreation place, including Danielsville Park, Delps Park and Indiantrail Park.
C. 
The permits granted for the consumption of alcohol shall only permit the consumption of alcohol in the pavilion areas of Danielsville Park, Delps Park or Indiantrail Park.

Prior to the issuance of any permit, all users of the recreation place agree to be held responsible for any damage to trees, buildings and facilities of the Township and the satisfactory cleaning up of the premises. Any expense incurred by the Township in repairing damaged property or cleaning of debris shall be billed to and paid by the individual or group issued the permit.

A. 
The Township assumes no responsibility for injury or death of any individual occurring within the recreation places, and all persons or organizations using said recreation places hereby agree to assume the risk of any such injury or death, and shall hold the Township harmless of and from any and all claims arising from said use, including reasonable attorney's fees.
B. 
The Township assumes no responsibility for the injury or death of any individual due to or caused by a person or persons who have consumed alcoholic beverages within Danielsville Park, Delps Park, or Indiantrail Park, and all persons and organizations participating in the function or gathering wherein alcoholic beverages are consumed hereby agree to assume the risk of any such injury or death and shall indemnify and hold the Township harmless of and from any and all claims arising from the consumption of alcoholic beverages, including reasonable attorney's fees.

A. 
At least one person from any organization applying for a permit to use the pavilion facilities of a recreation place or applying for a permit to use a recreation place and/or to consume alcoholic beverages at Danielsville Park, Delps Park or Indiantrail Park shall sign the written application form provided by the Township as an authorized representative of said organization, as well as individually.

B. 
The person and organization to whom the permit is issued for the use of the recreation place shall be responsible for those persons using said facilities, and said person and/or the officers of said organization shall be present at the recreation place on the date and during the times for which the permit was issued.
The Township reserves the right to refuse, at its discretion, any permit requested, for just cause, and further reserves the right to revoke any permit previously issued for just cause.

Pets shall be permitted at the Delps Park facility only. The following regulations shall apply:
A. 
Animals must be on a leash or under control of the owner at all times.
B. 
Animals are permitted in the walking track area and nonplaying areas. Animals are prohibited in areas being used for or set up for sports use.
C. 
Animals must display a current rabies tag and also have a current license.
D. 
Owners of animals are responsible for cleaning up after their pets or any damages caused by their pets.
The Township may, in the best interest of the Township, close the recreation places at any time.

Fees for the use of the pavilion facilities at the recreation places and security deposits for the use of said pavilion facilities shall be set by the Supervisors of the Township of Lehigh, from time to time, by a duly adopted motion. Security deposits shall be returned only when the recreation place has been inspected by the Township and the Township is satisfied that the person issued the permit has fulfilled his obligations under this chapter or any other rules and regulations for recreation places in the Township. The Township may retain any of the security deposit necessary to repair any damaged property or clean any debris, as more fully set forth in § 107-8.
The Township shall have the power, by ordinance or resolution, to establish additional rules and regulations from time to time as the need may arise. All persons visiting any of said recreation places shall be subject to said rules and regulations.

Penalties for violation of this chapter shall be as provided in Chapter 1, General Provisions, Article II.
