The Borough of Pennsburg hereby recognizes the authority of and hereby authorizes the Fire Department to recover the reasonable costs of equipment and materials involved in any hazardous material release, environmental incident, safety and rescue incident or operation, or vehicle incident from the person who caused the release of the hazardous material or that person's insurance company.
The scope of incidents covered, definitions of terms, and the procedure to recover the cost shall be consistent with 35 P.S. § 6022.210.
Said reasonable costs may be recovered directly by the Fire Department or through a third-party agency agreement.
In addition to the aforementioned reasonable costs, the Fire Department shall be authorized to collect reasonable interest, administrative fees, court costs, and attorney's fees, and any and all additional fees as may be authorized by the Hazardous Material Emergency Planning and Response Act (35 P.S. § 6022.101 et seq.), or as authorized by any other statutes or laws.
