There is hereby adopted in its entirety by the Borough of Pennsburg,
copies of which are on file in the office of the Borough, that certain
Mechanical Code known as the "International Mechanical Code, 2009
Edition, including Appendix A," as amended, through the effective
date of adoption of this chapter and as published by the International
Code Council which shall be referred to as the "Mechanical Code of
the Borough of Pennsburg."
This chapter shall regulate and govern the design, construction,
quality of materials, erection, installation, alteration, repair,
location, relocation or placement in addition to use and maintenance
of mechanical systems as herein provided; provide for the issuance
of permits and collection of fees thereunder and all of the regulations,
provisions, penalties, conditions and terms of said Mechanical Code
on file in the office of the Borough of Pennsburg are hereby referred
to, adopted and made part of as fully set out in this chapter with
the additions, insertions, deletions and changes, if any, prescribed
below.
Office of Code Enforcement. The provisions of Ordinance No.
3-88 (Code Enforcement Ordinance),[1] adopted by the municipality on December 5, 1988, are hereby
incorporated by reference and readopted with this chapter. The administration
and enforcement of this chapter and of the International Mechanical
Code, 2009 Edition, adopted herein, shall be carried out by the Office
of the Code Enforcement of the Borough of Pennsburg in accordance
with the procedures established by the Code Enforcement Ordinance
and by the International Mechanical Code, 2009 Edition, adopted herein.
It is the intent of Pennsburg Borough Council to adopt the International
Mechanical Code, 2009 Edition. However, in the event that the Commonwealth
of Pennsylvania, as part of the Uniform Construction Code, adopts
a later version of the International Mechanical Code, that edition
of the Code, as amended by the Commonwealth, shall become part of
the Code of Ordinances of the Borough of Pennsburg, without the need
for adoption of an amending ordinance.
A.
Saving clause. Nothing in this chapter or in the International Mechanical
Code, 2009 Edition, hereby adopted, shall be construed to affect any
suit or proceeding now pending in any court or any rights acquired
or liability incurred or any cause or causes of action accrued or
existing under any act or ordinance repealed hereby. No right or remedy
of any character shall be lost, impaired or affected by this chapter.
B.
Validity. The invalidity of any section or provision of this chapter
or of the International Mechanical Code, 2009 Edition, hereby adopted,
shall not invalidate other sections or provisions thereof.
C.
Conflict of ordinances. Any ordinance or part of any ordinance conflicting
with the provisions of this chapter be and the same is hereby repealed
insofar as the same affects this chapter.
D.
Short title. This chapter, together with the International Mechanical
Code, 2009 Edition, adopted herein, shall be known and may be cited
as the Mechanical Code of the Borough of Pennsburg.
