A person is guilty of a violation of this chapter if he or she has in his or her possession or control any alcoholic or malt beverage or a controlled substance in a public park or enters a public park in the Borough of Pennsburg in a manifestly intoxicated condition.
A person is guilty of a violation of this chapter if he or she operates or permits to be operated a motor vehicle, bicycle, minibike, triwheeler, go-cart, skateboard, roller skates or any other vehicle in or at a borough park.
A person is guilty of a violation of this chapter if he or she cuts, mutilates, removes or takes away any shrubs, flowers, trees or any park property.
A person is guilty of a violation of this chapter if he or she removes, defaces or damages any park property and fails to place all refuse and rubbish in the receptacles provided for that purpose.
A person is guilty of a violation of this chapter if he or she ignites or causes to be ignited any fire for any purpose on park property.

Animals are permitted on park property, provided that they are leashed and controlled at all times. All animal waste must be removed immediately by the owner or the individual in control of the animal.
Any person is guilty of a violation of this chapter if he or she erects a sign on any park property or makes personal solicitation on or around the park.
The hours of operation for the public park shall be dawn to dusk only, unless prior approval is obtained from the borough office by calling the Borough Secretary, Monday through Thursday, 9:00 a.m. through 12:00 noon.
Any person violating any of the provisions of this chapter shall be guilty of the offense charged and, upon conviction thereof and in a summary proceeding, shall be sentenced to pay the cost of prosecution of not more than $300 to be for the use of the borough and, in default of the payment thereof, shall be imprisoned for a period not to exceed seven days.
