The Town Manager shall be chosen exclusively on the basis of his/her executive and administrative qualifications, character, education, training and experience, and, when appointed, need not be a resident of the Town or of the state, but, during his/her tenure of office, shall reside within the Town, unless otherwise authorized by the Council, and shall devote his/her full time to the duties of his/her office.

A. 
The Town Manager shall be the chief executive officer of the Town and shall be directly responsible to the Council for the administration of all departments, agencies and offices in charge of persons or boards appointed by him/her and supervise and direct the same. He/She shall see that all laws and ordinances governing the Town are faithfully executed; shall make monthly reports to the Council and shall attend its meetings with full right to participation in its discussion but without a right to vote; shall prepare and cause to be printed, as soon as possible after the close of the fiscal year, an annual Town report; shall recommend to the Council such measures as he/she may deem necessary or expedient; shall keep the Council fully advised as to the financial condition of the Town; and shall prepare and submit to the Council an annual budget in accordance with Article IX of this Charter. He/She shall exercise such other powers and perform such other duties as may be required of him/her by ordinance or resolution of the Council not inconsistent with this Charter.
B. 
The Town Manager shall be the purchasing agent of the Town and all supplies, materials, equipment and other commodities required by any department, office, agency, board or commission of the Town, except the Town Board of Education, unless said Board shall designate the Town Manager as its purchasing agent, shall be purchased through him/her on requisitions signed by the head of the department, agency or office or chair of the board or commission. The Council may, by ordinance, establish rules and regulations for competition before purchase is made.
C. 
The Town Manager shall countersign all checks issued by the Town Treasurer except those countersigned by the Town Board of Education.

The Town Manager shall appoint all other officers and employees of the Town who receive compensation from the Town for their services as officers and employees, except as otherwise specifically provided by this Charter. In lieu of any appointment by the Town Manager to any office under his/her jurisdiction, the Town Manager may, in an emergency, perform the duties of any office under his/her jurisdiction, but the continuance of said performance shall be subject to the approval of the Council.
In case of disability or temporary absence of the Town Manager or vacancy in the office of the Town Manager, the Council may designate any person not a member of the Council to act as Acting Town Manager.

A. 
There shall be a Police Department which shall be subject to such rules and regulations as the Council may adopt and provide. The Town Manager shall have supervision and control over the Police Department in accordance with rules and regulations adopted by the Town Council. He/She shall appoint and promote the Chief and other members of such Department.
B. 
The members of such Police Department shall have such authority with respect to the service of criminal process and the enforcement of the criminal law as is vested by the general law in police officers.
