All terms and words appearing herein shall be
interpreted in conformity with the definitions given such terms and
words by the Vehicle Code of the Commonwealth of Pennsylvania.
No person shall stop, stand, park or leave unattended
any motor vehicle within the right-of-way, or any portion thereof,
on either side of Iroquois Court, as said court is located within
the Riverview Industrial Park for any time period between dusk and
dawn on any day of the week.
Signs conforming to standards promulgated by
the Pennsylvania Department of Transportation, and setting forth the
restrictions herein established, shall be erected in accordance with
this article and applicable regulations. Once said signs are erected,
the public shall be deemed to have notice.
The purpose of this article is to provide and
protect the public safety and welfare of the users of Iroquois Court
and, more specifically, to prevent the unlawful use of the court for
parking and vehicle maintenance.
The owner of any vehicle as determined by the
license number on the said vehicle shall be considered prima facie
as the person who parked the said motor vehicle within the confines
of the areas here and above set forth where parking is restricted.
Any person parking in the above-enumerated,
unauthorized area shall have committed a per se violation of this
article, and upon violation of this statute, vehicle of noncompliance
shall be towed, by those authorized to do so, by the Shirley Township
Board of Supervisors. Prior to the vehicle being returned to the owner,
the costs of towing shall be paid, and upon summary conviction before
a Magisterial District Judge, the owner of said vehicle shall be sentenced
to pay a fine of not less than $50 nor more than $1,000, plus the
costs of prosecution.
