A board to be known as the "Recreation Board
of Tinicum Township" is hereby created and established.

Said Recreation Board shall consist of seven
persons, residents of Tinicum Township, who shall be appointed by
the Commissioners of the Township, and shall consist of two Commissioners
of the Township and five laymen. One member of the Recreation Board
thus appointed shall serve for a term of one year, one for a term
of two years, one for a term of three years, two for a term of four
years and two for a term of five years, and at the expiration of the
term of any member of the Recreation Board, a successor shall be appointed
by the Commissioners of the Township to serve for a period of five
years. Vacancies in the office of the members of the Recreation Board
occurring otherwise than by expiration of term shall be filled by
the Commissioners of the Township for the unexpired term. The members
of the Recreation Board shall serve without compensation.

Said Recreation Board shall have custody and
control of and authority to supervise and maintain recreational facilities
provided by the Township and any lands that may be designated and
set apart for use as parks. The Recreation Board shall have power
to adopt rules and regulations for the conduct of all business within
its jurisdiction. The Recreation Board may employ such persons as
may be needed for the care, supervision, operation and maintenance
of any recreational facilities and parks that may be established by
the Township.
The members of the Recreation Board shall elect
their own Chairman and Secretary and select all other necessary officers
to serve for a period of one year.

Said Recreation Board shall have the right to
enter into contracts of purchase and employment related to the functions
delegated to the Recreation Board, provided that all such contracts
shall be within approved budgetary limitations, and provided further
that all advertising, conflict of interest and other provisions of
the First Class Township Code[1] shall be strictly complied with by the Recreation Board
in every respect as if the contract were entered into by the Township
of Tinicum itself.

The Commissioners shall retain the power to
award and enter into contracts in excess of $1,000, even though such
contracts may be within the budgetary allocations to the Recreation
Board. In all such contracts over $1,000 which are within said budgetary
allocations, bids shall be received by the Recreation Board, as the
Committee designated by the Township Commissioners to receive bids,
and the Recreation Board shall tabulate the bids or cause them to
be tabulated and make a recommendation to the Commissioners regarding
award of the contract. If said award shall be made by the Commissioners
in accordance with the recommendation of the Recreation Board, said
contract shall constitute an authorization for payment of the contract
sum and related expenditures from the recreation account, at such
time as sums due thereunder may become due and payable.

All appropriations for Recreation Board purposes
made by the Township Commissioners and the school district pursuant
to the Agreement of Cooperation entered into between them, as the
same may become due and payable, shall be deposited in a bank checking
account under the name "Township of Tinicum — Recreation
Account," as shall any other income received by the Recreation Board
from other sources, and the President of the Board of Commissioners
and the Secretary thereof are authorized and directed to issue orders
upon the Treasurer for the payment of funds, in form satisfactory
to meet the requirements of Section 804 of the First Class Township
Code,[1] and the Treasurer is authorized and directed to honor
such orders and issue checks upon said account upon written order
from the Chairman and Secretary of the Recreation Board, who shall
certify that any such order is within the scope of the powers and
duties delegated to said Recreation Board, and has been approved at
a meeting of the Recreation Board and is otherwise lawful and proper.
Responsibility for the accuracy of such certification shall rest upon
said officials of the Recreation Board, and said three signatories
of the Township's checks shall not be obliged to question the same.
