A.
Title. An ordinance providing for the regulation and
control of the subdivision of lots and the development of land; the
approval of plans, plots or replots of land laid out in building lots;
standards for the design of streets, lots, easements, blocks and other
improvements; minimum improvements and construction standards on all
streets and required dedications; the administration of this chapter
and penalties for the violation of this chapter.
B.
Short title. This chapter shall be known and may be
cited as the "Whitehall Township Subdivision and Land Development
Ordinance of 1999."
A.
Authority. The Township of Whitehall is empowered
to regulate subdivisions and land development within the Township
by virtue of the provisions of the Pennsylvania Municipalities Planning
Code.
B.
Application.
(1)
No subdivision of development of any lot, tract or
parcel of land shall be made, and no street, sanitary sewer, water
main, gas or electric transmission line (except those constructed
by utilities regulated by the Pennsylvania Public Utility Commission),
or other improvements in connection therewith shall be laid out, constructed,
opened or dedicated for public use or travel or for the common use
of occupants of buildings abutting thereon, except in accordance with
this chapter.
(2)
No lot in a proposed subdivision or land development
may be sold, and no final permit to erect any building or structure
upon land in a subdivision or land development may be issued, unless
and until a final plan has been approved and recorded and either the
Township has been assured by means of an improvements agreement acceptable
to the Mayor and Township Solicitor that the improvements will subsequently
be installed or the required improvements in connection therewith
have been constructed.

This chapter shall apply to all subdivisions and land
development applications filed after the effective date hereof and
to all subdivisions and land developments which have received preliminary
plan approval from the Board of Commissioners more than five years
prior to the effective date of this chapter.
A.
Purpose. It is the intent, purpose and scope of this
chapter to:
(1)
Protect and promote the safety and health of the residents
of the Township of Whitehall.
(2)
Assure the coordinated and thoughtful development
of the community in accordance with the Township of Whitehall Comprehensive
Plan.
(3)
Provide for the general welfare and convenience and
assure governmental economies through the planned development of streets,
utilities and public facilities.
(4)
Secure adequate sites for recreation, conservation,
historic, scenic and other open spaces.
(5)
Facilitate the efficient movement of traffic.
(6)
Improve land records by establishing standards for
surveys and plans.
The Whitehall Township Subdivision and Land
Development Ordinance of 1971, and all amendments thereto are hereby
repealed, except as to land development plans (as such term is defined
hereinafter) which have been:
A.
Officially submitted to the Township prior to the
effective date of this chapter and are in good standing as of the
date of the enactment of this chapter.
B.
Land development plans which have been approved by
the Board of Commissioners less than five years prior to the effective
date of this chapter.
C.
As may otherwise be required by law. This chapter
does not repeal provisions of other laws or ordinances except those
specifically set forth herein.
