Local Law No. 2-1993, authorizing the Probation
Department to collect administrative fees in certain cases, is hereby
repealed as of the effective date of this article.
A.
Every person convicted of a crime committed in Sullivan
County and on probation on the effective date of this article shall
pay an administrative fee of $30 per month for probation services
from the effective date of this article until probation is terminated.
B.
Every person convicted of a crime, regardless of where
the crime was committed, and serving all or part of a sentence of
probation under the supervision of the Sullivan County Probation Department
shall pay an administrative fee of $30 per month or any part of a
month for probation services for as long as that person remains under
such supervision.

C.
The fee shall not be imposed as a condition of probation.
D.
The fee established by this article may be changed
from time to time by resolution of the County Legislature.

The Director of Probation shall have the power
to waive all or part of the fee where, because of the indigence of
the person convicted, the payment of the fee would work an unreasonable
hardship on the person convicted, on his or her immediate family,
or on any other person dependent upon the person convicted for financial
support.

A.
The Sullivan County Sheriff shall charge the following
administrative fees:
(1)
For fingerprinting for any purpose other than the
prosecution of a criminal action or the processing or supervision
of inmates in the custody of the Sheriff: $5.
(2)
For issuance of a letter of good conduct or similar
document: $10.
(3)
For taking custody of a pistol permit or weapon pursuant
to court order during the pendency of a criminal proceeding: $10.
B.
The fees established by this article may be changed
from time to time by resolution of the County Legislature.

This article shall only be applicable to services
provided by the Sullivan County Clerk other than in his capacity as
Clerk of the Supreme Court or of the County Court, and other than
in an action pending in a court of which he is clerk.
The provisions of this article shall become
effective 30 days after this article shall become effective. This
article shall become effective upon filing with the New York State
Secretary of State.
