All aboveground oil tanks, aboveground propane tanks, air-conditioning equipment, compressors and generators installed on and after April 2, 2009, shall be located in the rear or side yards immediately adjacent to the dwelling, except that accessory equipment shall be permitted within the aggregate portion of the side yard setback. All equipment which is the subject of this § 213-1 and which was lawfully installed prior to April 2, 2009, may remain in its location and be replaced an indefinite number of times. The burden of proof shall be on the resident to show, through reasonable means, that the equipment existed prior to April 2, 2009.
All accessory equipment, including, but not exclusively, air-conditioning compressors, generators, aboveground oil tanks, and aboveground propane tanks, installed on and after April 2, 2009, shall be adequately screened from view from both the roadway and adjacent properties by the homeowner through evergreen plantings or fencing.
Any violation of the sections in this chapter shall result in a fine of $500 per day for each day or part of a day that a violation remains.
