There shall be a Borough Administrator who shall be appointed by the Mayor with the advice and consent of the Council to serve at the pleasure of the Mayor and Council. The Borough Administrator shall receive compensation as fixed annually by the Borough Council.

The Borough Administrator shall be the chief administrative officer of the Borough and shall perform those duties assigned by the Mayor and Council which duties to the extent not prohibited by law, shall include but not be limited to the following:
a. 
General administration.
1. 
Attend meetings of the Mayor and Council as required by the Mayor and Council;
2. 
Conduct a continuing study of the administrative and other operations of the Borough and make recommendations to the Mayor and Council for plans and programs to meet the needs of the Borough;
3. 
Receive and reply to inquiries concerning Borough business and provide information and assistance in respect thereto;
4. 
Supervise the administration of operations and business of all departments, commissions, offices and boards (throughout this ordinance, the word "board" shall be deemed not to include the Board of Public Works) of the Borough and consult with the respective committee chairmen and department heads in connection therewith;
5. 
Maintain liaison with department heads, commissions, offices and boards and advise the Mayor and Council of operations and projects in progress;
6. 
Establish and maintain personnel practices in accordance with the policies created by the Mayor and Council and maintain appropriate personnel records;
7. 
Maintain a continuing review of all department and office operations and their expenditures and report thereon to the Mayor and Council;
8. 
Implement the policy of the Mayor and Council with respect to the compiling and releasing of public information.
b. 
Budgeting.
1. 
Secure from each department, commission, office and board its annual request for appropriations and prepare the tentative budget, transmitting same with his recommendations and comments to the Mayor and Council;
2. 
Consult with the Mayor and Council with respect to the tentative budget, recording changes, additions and deletions thereto, and by January 15 of each year, or as soon thereafter as possible, submit the tentative budget in the form required by law together with an analysis of the various items of expenditure and revenue and such explanatory comments as may be required.
c. 
Purchasing. Exercise the duties of Purchasing Agent and as such, purchase all material, supplies, equipment, work and labor required by all departments, commissions, offices and boards and cause a purchase order to be issued for same upon authorization of a department head or as directed by the Mayor and Council, but only to the extent that funds have been provided for in the annual budget or except as may be specifically authorized in case of emergency and, where necessary, provide for competitive bidding.

The Borough Administrator shall devote full time to the interests of the Borough, but nothing herein shall prevent the Borough Administrator from holding the office of Borough Clerk and/or other official positions in the Borough.

There shall be a Borough Clerk appointed by the Mayor and with the advice and consent of the Borough Council. The term of office of the Clerk shall be three years which shall run from January 1 in the year in which the Clerk was appointed.

No person shall be appointed as Borough Clerk unless he shall have a registered Municipal Clerk Certificate issued pursuant to N.J.S.A. 40A:9-133 et seq.

The Borough Clerk shall receive compensation as fixed annually by the Borough Council.

The Borough Clerk shall:
a. 
Act as secretary of the municipal corporation and custodian of the municipal seal and of all minutes, books, deeds, bonds, contracts, and archival records of the municipal corporation. The Borough Council may, however, provide by ordinance that any other specific officer shall have custody of any specific other class of record.
b. 
Act as secretary to the Borough Council, prepare meeting agendas at the discretion of the Council, be present at all meetings of the Council, keep a journal of the proceedings of every meeting, retain the original copies of all ordinances and resolutions, and record the minutes of every meeting.
c. 
Serve as the chief administrative officer in all elections held in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated.
d. 
Serve as chief registrar of voters in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated.
e. 
Serve as the administrative officer responsible for the acceptance of applications for licenses and permits and the issuance of licenses and permits, except where Statute or ordinance has delegated that responsibility to some other Borough officer.
f. 
Serve as coordinator and records manager responsible for implementing local archives and records retention programs as mandated pursuant to Title 47 of the New Jersey Statutes Annotated.
g. 
Perform such other duties as are now or hereafter imposed by statute, regulation or by ordinance.
h. 
Approve the granting of raffle and bingo licenses to be held in the Borough.

a. 
Office created. Pursuant to N.J.S.A. 40:46-2.1 the office of Deputy Borough Clerk is hereby created in the Borough.
b. 
Appointment and confirmation. The Deputy Borough Clerk shall be appointed by the Mayor and confirmed by the Council in accordance with the laws relating to appointive officers.
c. 
Terms of office. The term of office of the Deputy Borough Clerk shall be for one year and shall continue until the successor to the office shall have been appointed and confirmed or until the office shall have been abolished.
d. 
Powers and duties. The Deputy Borough Clerk shall assist and be under the direction of the Borough Clerk in the performance of his duties and shall perform such other duties as the Borough Council may prescribe. In the absence or temporary disability of the Borough Clerk, the Deputy Clerk shall perform the duties of the Borough Clerk.
e. 
Compensation. The Deputy Borough Clerk shall receive compensation as fixed annually by the Borough Council.

There shall be a Chief Financial Officer who shall be appointed by the Mayor with the advice and consent of the Borough Council for a four-year term commencing January 1 of the year in which he/she is appointed. The Mayor with the advice and consent of the Borough Council may appoint such Assistant or Deputy Municipal Financial Officers as it sees fit. The Chief Financial Officer shall be under the general supervision of the Borough Administrator and under the specific direction of the Borough Administrator.

The Chief Financial Officer shall have responsibility for the fiscal records of the Borough as well as:
a. 
Preparing and signing all federal and state returns, statements, and reports requiring the signature of the Chief Financial Officer.
b. 
Advising and assisting the Mayor and Council in regards to developing fiscal plans and forecasts for the Borough.
c. 
Providing financial assistance to all boards, commissions and departments of the Borough.

The Chief Financial Officer shall:
a. 
Receive funds entrusted, received or under the control of any department and deposit all funds received by him/her in depositories authorized by the governing body by resolution.
b. 
Have custody of all investments and invested funds of the Borough or in possession of the Borough in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Borough not required for current operations safely invested or deposited in interest bearing accounts.
c. 
Have the safekeeping of all bonds and notes of the Borough and the receipt and delivery of the Borough bonds and notes for transfer, registration or exchange.
d. 
Keep a full account of all cash receipts and disbursements of the Borough and at least once each month, or more often if the governing body requires, furnish the governing body with a statement of all moneys received and expended by him/her.

The Chief Financial Officer and any Assistants or Deputies shall receive compensation as shall be fixed annually by the Borough Council.

a. 
Notwithstanding the provisions of any other law to the contrary, any person who has served as the Chief Financial Officer of the Borough for four consecutive years and who is reappointed as the Borough's Chief Financial Officer shall be granted tenure of office upon filing with the Borough's Clerk and with the Division of Local Government Services in the Department of Community Affairs a notification evidencing his compliance with this section.
b. 
Thereafter, the person shall continue to hold office during good behavior and efficiency, and shall not be removed therefrom except for just cause and then only after a public hearing upon a written complaint setting forth the charge or charges against him pursuant to N.J.S.A. 40A:9-140.9 or upon expiration or revocation of certification by the Director pursuant to N.J.S.A. 40A:9-140.12.

There shall be a Borough Engineer who shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of three years.

The Borough Engineer shall be a duly licensed professional engineer of the State of New Jersey and shall provide professional engineering advice and assistance to the governing body and Planning Board; provide engineering advice to the Board of Adjustment in connection with subdivision, site plan and variance applications and Master Plan studies; maintain the Borough Official Map and Borough Zoning Map; prepare plans and specifications for public works authorized by the governing body; and make such field surveys as may be required therefor; make such inspections of the work of public contractors as may be necessary or desirable; supervise the performance of public works contracts and certify the amounts due and payable thereunder; and provide any and all other professional engineering advice and assistance as may be required of him by Statute or as requested of him by the governing body, whether by ordinance, resolution or otherwise.

The Borough Engineer shall receive compensation as fixed annually by the Borough Council.

There shall be a Borough Attorney who shall be appointed by the Mayor with the advice and consent of the Council for a term of one year.

The Borough Attorney shall be an attorney-at-law of the State of New Jersey and shall be the legal advisor of the Borough of Ramsey and he shall render advice on all legal questions affecting the municipality whenever requested to do so by the governing body. He shall perform legal services on behalf of the Borough and its officers and several boards, except for such boards as are required by law to be represented by an attorney other than the Borough Attorney and except for the services required to be performed by the Borough Prosecutor.

The Borough Attorney shall receive compensation as fixed annually by the Borough Council.

a. 
Any other provision of law to the contrary notwithstanding, the Borough or any of its purchasing agents or agencies or those of its independent authorities, as the case may be, shall not enter into an agreement or otherwise contract to procure services from any professional business entity, if that entity has solicited or made any contribution of money, or pledge of a contribution, including in-kind contributions, to a campaign committee of any candidate or holder of the public office having ultimate responsibility for the award of the contract, or to any municipal or county party committee or any political party organization in excess of the thresholds specified in Paragraph d within one calendar year immediately preceding the date of the contract or agreement.
b. 
No professional business entity which enters into negotiations for, or agrees to, any contract or agreement with the Borough or any department or agency thereof or of its independent authorities for the rendition of professional services shall knowingly solicit to make any contribution of money, or pledge of a contribution, including in-kind contributions, to any municipal candidate or holder of the public office having ultimate responsibility for the award of the contracts, or to any municipal or county party committee or any political party organization between the time of the first communications between that business entity and the Borough regarding a specific professional services agreement and the later of the termination of negotiations or the completion of the contract or agreement.
c. 
For purposes of this section, a "professional business entity" seeking a public contract means an individual, including the individual's spouse, if any, and any child living at home; person; firm; corporation; professional corporation; partnership; organization; or association. The definition of a "business entity" includes all principals who own 10% or more of the equity in the corporation or business trust, partners, and officers in the aggregate employed by the entity as well as any subsidiaries directly controlled by the business entity.
d. 
Any individual meeting the definition of "professional business entity" under this section may annually contribute a maximum of $300 each for any purpose to any candidate for Mayor and Council, or $300 to any municipal or county party committee or any political party organization without violating Paragraph a of this subsection. However, any group of individuals meeting the definition of "professional business entity" under this section, including such principals, partners, and officers of the entity in the aggregate, may not annually contribute for any purpose in excess of $600 to all municipal candidates or office holders with ultimate responsibility for the award of the contract, or municipal or county committee or any political party organization or political parties combined, without violating Paragraph a of this subsection.
e. 
For the purposes of this section, the office that is considered to have ultimate responsibility for the award of the contract shall be:
1. 
The Mayor and Council of the Borough of Ramsey if that contract requires approval or appropriation from the governing body.
No contribution of money or any other thing of value, including in-kind contributions, made by a professional business entity to any Borough of Ramsey candidate for Mayor or Borough Council or Borough of Ramsey or Bergen County party committee shall be deemed a violation of this section, nor shall an agreement for property, goods, or services of any kind whatsoever be disqualified thereby, if that contribution was made by the professional business entity prior to the effective date of this section.
a. 
Prior to awarding any contract or agreement to procure services with any professional business entity, the Council or any of its purchasing agents or agencies, as the case may be, shall receive a sworn statement from the professional business entity made under penalty of perjury that the bidder or offeror has not made a contribution in violation of Subsection 2-12.1 hereof.
b. 
The professional business entity shall have a continuing duty to report any violations of this section that may occur during the negotiation or duration of a contract. The certification required under this subsection shall be made prior to entry into the contract or agreement with the Borough and shall be in addition to any other certifications that may be required by any other provision of law.
A professional business entity, or Borough of Ramsey candidate or officeholder, or Borough or Bergen County party committee may cure a violation of Subsection 2-12.1 if, within 30 days after the general election, the professional business entity notifies the Borough Council in writing and seeks and receives reimbursement of a contribution from the municipal candidate or municipal or Bergen County political party.
a. 
All Borough of Ramsey professional service agreements shall provide that it shall be a breach of the terms of the government contract for a professional business entity, as defined in Subsection 2-12.1c, to violate Subsection 2-12.1b or to knowingly conceal or misrepresent contributions given or received, or to make or solicit contributions through intermediaries for the purpose of concealing or misrepresenting the source of the contribution.
b. 
Any professional business entity, as defined in Subsection 2-12.1c, who knowingly fails to reveal a contribution made in violation of this section, or who knowingly makes or solicits contributions through intermediaries for the purpose of concealing or misrepresenting the source of the contribution, shall be disqualified from eligibility for future municipal contracts for a period of four calendar years from the date of the violation.

There shall be a Tax Collector who shall be appointed by the Mayor with the advice and consent of the Borough Council.

No person shall be appointed or reappointed as Tax Collector unless he shall hold a Tax Collector's Certificate issued pursuant to N.J.S.A. 40:9-145.3. Any Tax Collector appointed pursuant to this section may obtain tenure pursuant to the provisions of N.J.S.A. 40A:9-144 or 40A:9-145. Any person who shall be reappointed Tax Collector subsequent to having received a Tax Collector's Certificate pursuant to N.J.S.A. 40A:9-144.3 and having served as Tax Collector or who has performed the duties of Tax Collector for not less than four consecutive years immediately prior to such reappointment shall have acquired tenure and shall hold his or her office during good behavior and efficiency and shall be removed only for good cause shown and after a proper hearing before the Director of the Division of Taxation or his designee in accordance with the provisions of N.J.S.A. 40A:9-145.8.

The Tax Collector shall hold his office for a term of four years from January 1 next following his appointment. Vacancies other than due to the expiration of term shall be filled by appointment for the unexpired term.

The Tax Collector shall receive compensation as fixed annually by the Borough Council.

There shall be a Tax Assessor who shall be appointed by the Mayor with the advice and consent of the Borough Council.

The Tax Assessor shall hold the Tax Assessor's Certificate provided for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing property for the purpose of general taxation. Nothing in this section shall affect adversely the salary or tenure rights acquired pursuant to N.J.S.A. 54:1-35.31 or any other law. In accordance with the provisions of N.J.S.A. 54:3-16, the Assessor, when making assessments, shall be governed by directions by the Bergen County Tax Administrator. These directions shall be pursuant to rules adopted by the Bergen County Tax Board.

The Tax Assessor shall hold office for a term of four years. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.

a. 
The office of the Superintendent of Public Works is hereby created in the Borough pursuant to N.J.S.A. 40A:9-154.5. The Superintendent of Public Works shall also be known as the Principal Public Works Manager and shall have management responsibility for the entire Public Works Department and all other Public Works employees shall report to and be supervised by the Superintendent of Public Works (Principal Public Works Manager).
b. 
The Superintendent of Public Works may hold additional positions with the Borough. The Superintendent of Public Works may serve as the Borough Engineer, provided that he or she meets all of the qualifications of that position and further holds any and all certificates, licenses, or other state-mandated indicia of qualification for such position. The governing body may, by resolution, elect, but is not required, to join the title(s) of the positions, and the compensation for the combined positions shall then be as set forth by the Salary Ordinance and resolution.

The Superintendent of Public Works shall be appointed by the Mayor with the advice and consent of the Borough Council in accordance with the laws relating to appointive officers.

Areas of supervision of the Superintendent of Public Works include the maintenance and upkeep of:
a. 
Public buildings and grounds;
b. 
Streets;
c. 
Parks and playgrounds;
d. 
Recycling;
e. 
Municipal waste (solid waste garbage collection);
f. 
Public water supply;
g. 
Wastewater collection;
h. 
Stormwater collection;
i. 
Repair and maintenance of mechanical equipment and vehicles; and
j. 
Supervision of Public Works employees.

There shall be a Recreation Supervisor who shall be appointed by the Mayor with the advice and consent of the Council as set forth in N.J.S.A. 40:87-16. The Recreation Supervisor shall be appointed for a term of one-year commencing January 1 and until his successor shall be appointed and qualify. The Recreation Supervisor shall receive compensation as fixed annually by the Borough Council.

The Recreation Supervisor shall perform the duties of Recreation Director which shall be as follows:
a. 
He shall be responsible for the development of all Borough Recreation Commission activities and programs established by the Commission and shall implement such activities and programs in accordance with the policies of the Commission.
b. 
He shall obtain approval from the Commission of all proposed assistants for Commission activities and programs.
c. 
He shall maintain and make available to the Commission records of all personnel and purchases.
d. 
He shall make monthly reports to the Commission with regard to its activities and programs and shall include in such reports the revenue, expense, and participation in such activities and programs. He shall also maintain and make available to the Commission payroll records, time sheets and disbursement records in accordance with all Commission activities and programs.

There shall be a Swimming Pool Director who shall be appointed by the Mayor and confirmed by the Council in accordance with the laws relating to appointive officers. The Swimming Pool Director shall be appointed for one year and shall continue until his successor shall be appointed. The Swimming Pool Director shall receive compensation as fixed annually by the Borough Council.

The Swimming Pool Director shall perform the duties of Municipal Swimming Pool Director which shall be as follows:
a. 
Direct the operation of the municipal swimming pool in accordance with the policies of the Municipal Swimming Pool Commission.
b. 
Supervise the Assistant Swimming Pool Director in the duties delegated to him.
c. 
Direct the Supervisor of the snack bar in its operation and in financial accounting.
d. 
Report to the Commission any and all matters pertinent to the operation of the pool.
e. 
Maintain payroll and time sheets for all employees of the pool.
f. 
Account for all moneys received through the pool office.
g. 
Verify, in writing, receipt of all supplies purchased.
h. 
Verify and attest to all work done by Borough employees (other than pool employees) for pool maintenance.
i. 
Maintain strict control of personnel who have access to the pool office.
j. 
Supervise, instruct and discipline pool personnel.
k. 
Supervise, control and discipline members and guests using pool facilities.
l. 
Attend all Pool Commission meetings as required.
m. 
Supervise enrollment of pool members and issue appropriate badges.
n. 
Employ and terminate personnel below the position of Assistant Director.

The office of Consumer Affairs of the Borough of Ramsey is hereby created and established pursuant to the provisions of N.J.S.A. 40:23-6.47 et seq.

The office of Consumer Affairs shall be administered by a Municipal Director of Consumer Affairs who shall be appointed by the Mayor with the advice and consent of the Council for a term of one-year commencing January 1st and until his successor shall be appointed and qualify.

The Mayor, with the advice and consent of the Council, may appoint not more than two Assistant Municipal Directors of Consumer Affairs who shall assist the Municipal Director of Consumer Affairs in the performance of his duties. Such appointments shall be for a term of one-year commencing January 1st and until their successors shall be appointed and qualify.

The Municipal Director of Consumer Affairs and the Assistant Municipal Director of Consumer Affairs shall serve without salary or any form of compensation.

The Municipal Director of Consumer Affairs and the Assistant Municipal Directors of Consumer Affairs shall exercise such powers and perform such duties as set forth in N.J.S.A. 40:23-6.47 et seq. and as outlined by the State of New Jersey, Department of Law and Public Safety, Division of Consumer Affairs, and as assigned by the Borough Council.

Prior to appointment to the positions of Municipal Director of Consumer Affairs or Assistant Municipal Directors of Consumers Affairs a person shall possess the qualifications established for such positions by the Attorney General of the State of New Jersey.

The Municipal Director of Consumer Affairs and the Assistant Municipal Directors of Consumer Affairs shall, when requested by the Borough Council, submit a report to the Borough Council of their activities.

There is hereby created the position of Purchasing Agent for the Borough of Ramsey, Bergen County, New Jersey.
The Purchasing Agent shall be appointed by the Mayor with the advice and consent of the Council.
The Purchasing Agent is required to possess a valid qualified purchasing agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs
The Purchasing Agent shall have, on behalf of the Mayor and Council of the Borough of Ramsey, the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by state regulatory agencies; and conduct any activities as may be necessary or appropriate to the purchasing function of the Borough of Ramsey.
The bid threshold for the Borough of Ramsey pursuant to Local Finance Notice 2010-13 and N.J.A.C. 5:34-5.2 shall be $36,000.
